RULES AND REGULATIONS

The students have to keep in mind these rules while pursuing their internships:-

  • The students shall be given certain tasks to be done within a specified amount of time. If they fail to complete such tasks, it shall lead to their disqualification.
  • Misbehavior on the part of any student shall not be entertained and strict action shall be taken against them.

About The Event

The Law Street and Shri Pushkar Singh Baghel Memorial Committee is organizing 1st Pushkar Singh Baghel Memorial National Online Memorial Writing Competition in the memory of renowned advocate Late Shri Pushkar Singh Baghel, in collaboration with Central Law Publications, Law Literature Publications and MemoPundits. We as an organization have decided to undertake this initiative to enlarge the spectrum of learning and encourage students to sharpen their research and drafting skills.

Introduction

Crime and criminals are indeed looked upon in society with greatest hatred. Nevertheless, it is our society that prepares the crime and the criminal commits the same. Criminal laws have been established to curb crime and criminals. Criminal law is a broad field consisting of three major principal acts. They are: –

  • The Indian Penal Code, 1860
  • The Indian Evidence Act, 1872
  • The Criminal Procedure Code, 1973.

The Indian Penal Code is a substantive law while the Indian Evidence Act and the Code of Criminal Procedure come under the ambit of procedural laws. Before we start our journey from investigation to trial, we must go through a few important definitions: –

  1. Cognizable Offence – Cognizable offence means an offence in which a police officer has the authority to make an arrest without a warrant and to start an investigation with or without the permission of a court. The police can file a First Information Report (FIR) for cognizable offences only. In Cognizable cases, police can make the investigation without the prior permission of the Magistrate. Cognizable cases are more serious than the non-cognizable cases. Normally, serious offences are defined as cognizable and usually carry a sentence of 3 years or more.
  • Non-cognizable Offence – They are those categories of offences, which, as per Criminal Procedure Code (1973), the Police can neither register the FIR nor can investigate or effect arrest without the express permission or directions from the court of law are known as Non-cognizable offences. These include minor offences such as abusing one another, minor scuffles without injuries, intimidation, etc.

Once the type of offence has been acknowledged, the investigation process begins. The steps which take a case from investigation stage to trial are as follows: –

THE EVIDENCE PHASE – After the FIR has been filed by the police, the investigation begins. The investigation is done in order to gather evidence by: –

  • Gathering of proofs or collection of evidence
  • Statement of witnesses
  • Interrogation or cross-examination
  • Logical examination or scientific analysis

Types of Evidences

  1. Recording of Statements under sector 161 of CrPC. Where an offence is submitted under area 354, 376, or 509 of the I.P.C, the announcement of the charge must be enrolled by the Magistrate under sector 164 of the CrPC.
  • Gathering of Evidence in the type of Documents and others.
  • Recording of admissions or articulations under area 164 Cr.PC before the Magistrate.

During this examination, the Police make captures and are proceeds with the generation of the accused before the Magistrate. The charged must be presented before the justice within 24 hours of capture by the Police.

After the accused is produced before the Magistrate, the following further processes begin.

Remand or Bail

Whenever an accused is arrested for any offense and the police are unable to complete the investigation within 24 hours then such accused is produced before a magistrate, requesting an extension of custody. The magistrate can grant police custody to the accused which shall not exceed more than 15 days in the entire considering of the application. However, if the magistrate does not seem to be convinced, then the accused is taken to magisterial custody. However, the magistrate under section 167 (2) (a) of the Criminal Procedure Code, may authorize the detention of the accused person. Otherwise, if he is satisfied that adequate grounds exist in doing so, he is kept in the custody of police for a period of beyond fifteen days. However, no magistrate shall authorize custody for more than: –

  1. Ninety days, where the examination of an offence is culpable with death, detainment for a long time or detainment for a term at the very least ten years.
  • Sixty days, in case of examination of some other offence.

On the expiry of the 90 days or 60 days, the denounced can be allowed safeguard by applying for an award of safeguard, inside the arrangements of section 436, 436, and 439 of CrPC.

Final Report (Section 173)

The police, after finishing the examination need to document the final report under Section 173 of the Criminal Procedure Code. This marks the end of the examination and the proof gathered by the investigating team.  If the evidence collected against the accused is insufficient then the police may file a report under Section 169 of the Criminal Procedure Code and release the accused on executing a bond and undertaking for appearing the Magistrate empowered to take cognizance. The last report will of 2 types.

  1. Conclusion Report.
  2. Charge sheet/Final report

A Closure Report

A closure report or a conclusion report is filed when the police possess no evidence to prove that the alleged crime has been committed by an accused. After the closure report is filed the magistrate has the following four options: –

  1. Accept the report and close the case.
  2. Direct the police investigating team to investigate the matter further if he/ she thinks that there are still some loopholes in the investigation.
  3. Issue a notice as he is the only person who can challenge the concluding report.
  4. Might reject the closure report and take cognizance under Section 190 of the Criminal Procedure Code and Section 204 of the Criminal Procedure Code issue summons to the accused and direct his appearance to the magistrate.

Charge Sheet or Final Report

A charge sheet incorporates the elements of the offense committed in a prescribed form, the complete investigation report of the Police authorities, and the charges slapped against the accused. It includes briefed facts, all statements recorded under section 161, 164 of the Criminal Procedure Code, a copy of the FIR, a list of witnesses, a list of seizures, and other documental evidence. According to Chapter 6 of the Criminal Procedure Code, on the filing of the charge sheet, the accused may be issued a summons by the magistrate to appear before him on a given date. On the filing of the charge sheet, the Magistrate takes cognizance of the matter under Section 190 of the Criminal Procedure Code. The court, if it deems fit, can reject the charge sheet and discharge the accused or can accept it and frame the charges and, post the case for trial.

Beginning of Trial Process

Here, the journey continues inside the courtroom. If the accused pleads guilty, he is convicted. If the accused pleads not guilty, the trial process begins.

  • Opening of the Case: The case is opened in the court of law by the Prosecutor, who clarifies the court about the charges put on the accused in the charge sheet. However, the accused can anytime record an application under Section 227 of the Criminal Procedure Code 1973 for releasing him for the changes provided that the charges against him are false and are not solid or adequate to continue against him in the preliminary.
  • Evidence Presented by the Prosecution: Witnesses from both sides are analyzed. The phases of proof include Examination of Chief, Cross-Examination, and Re-examination. To prove the guilt of the accused, the prosecution is required to produce evidence before the Court. The proof or evidence must be backed by the witnesses’ statement. This procedure is known as “examination in boss”. The magistrate has the power to issue summons to any individual as a witness or request him to produce a document before the Court. Sections of the Criminal Procedure Code 1973 applicable here are:

Section 233- Session trial

Section 242- Warrant trial

Section 254- Summons trial

  • Statement of the Accused: After the evidence produced by the Prosecution, the statement of the accused is recorded under Section 313 for the CrPC. An oath is not considered during the recording of any statement. The accused at that point says his or her realities and conditions of the case. Anything recorded during this process can be utilized against that person at any later stage.
  • Witness of the Defense: The defense, after the statement of the accused, produces oral and narrative evidence. This is under Section 233 for sessions trial, Section 243 for warrant trial, Section 254 (2) for the request of summons trial. In India, the defense is usually not required to give any proof as the burden of proof is on the Prosecution.
  • The Final Arguments: The last arguments are presented by the Public Prosecutor and the defense counsel. As indicated in Section 314 of the Criminal Procedure Code, any party to any proceeding may, soon after the end of his evidence, address concise oral arguments, and may, before he finishes up the oral contentions, if any, submit a memorandum to the Court presenting succinctly and under distinct headings, the arguments in support of his case. Every such jotting will form a part of the record. A copy of every such jotting shall be provided to the contrary party.
  • The Judgement: After hearing all the arguments, the judge decides whether to convict the accused or acquit him. This is known as judgment. This also Incorporates session trial contained in Section 235, warrant trial in Section 248, and summon trial under Section 255 of the CrPC. If the accused is convicted, then both sides present their arguments on the punishment. This is usually done if the punishment is life imprisonment or capital punishment.

After hearing the arguments from both sides, the court finally decides what should be the punishment for the accused. Various theories of punishment are considered such as the reformative theory of punishment and the deterrent theory of punishment. The age, background, and history of the accused also kept in mind while giving the judgment.

Conclusion

I would like to conclude by saying that crime never pays. The journey from investigation to trial is not a bed of roses. Many individuals including the Police officials, the lawyers, and the judges have a vital role to play at every stage. From investigation to the gathering of evidence to the trial, all play their roles appropriately, bravely as well as being fair and honest. When law and order start working hand-in-hand, crime and criminals very soon be wiped out of the society. We must always keep in mind that punishment is the last and the least effective instrument given to curb crime and criminals. We must make efforts to reduce crime rates and make the world a better place.

  1. FORMAT OF THE DEBATE

Participation shall be on Individual basis (1 vs. 1)

2. TIME LIMITS  FOR EACH SPEAKER-

Preliminary Rounds- 12 Minutes (Including rebuttals)  

Semi-Final Rounds- 15 minutes (Including rebuttals)

Final Rounds- 20 Minutes (Including rebuttals)

3. RULES

a. As for now, there are three rounds planned:

  • Preliminary Round
  • Semi-finale Round
  • Final Round

Based on the no. of registration, an additional round “Quarter-final Round” will be added and the same will be communicated by 17th September.  The rules and topic for the Quarter-final Round will be same as that of the Preliminary Round.

b. The topic for the Preliminary Round is “Encounter Killings: Social Acceptance or a Shame on Judicial System?”

c. The topic for the Semi-finale Round and the Final Round will be notified on 26th September after the declaration of the result of the Preliminary Round.

d. The topic for the Semi-finale Round and the Final Round will be same.

e. All must be presented in English.

f. Since, the debate is conducted on an online platform; each participant’s video should be turned on throughout the round. However, Microphone should be turned on only when it is his/her chance to speak.

g. Exceeding the total time would attract negative marking.

h. The opinion of the speaker must be backed up by a legal principle, theory or any provision.

i. If a Speaker cites any facts, he/she must give full details of the news article, report, etc., from which the facts were cited.

j. Decision of the Judges would be final.

b. Only the first Speaker is allowed to do “Rebuttal”. However, based on the discretion of the Judges, second Speaker could be allowed to counter the “Rebuttal”.

c. While “Rebuttal”, the Speakers must adhere to the disciplinary guidelines that include:

  • No personal comment on the other Speaker’s arguments/presentation
  • The counter-points must be backed up by legal principles, theories and other reports.
  • The Speaker must stop speaking once his/her allotted time gets over. The moderator will inform about the same. However, he/she may ask for an extension from the Judges, if allotted, he she/she can continue.

5. POST REGISTRATION

All the participants will be added in a WhatsApp group on 17th September, 2020. Post that, all the communication will be held in the group itself.

Further Guidelines

  • Submissions are reviewed on a rolling basis. Currently, the Journal is inviting submissions for its 7th Volume. The deadline for sending submissions for the forthcoming volume is October 20, 2020.
  • Submissions must be made in electronic form to nlsblr@nls.ac.in under the subject heading ‘NLSBLR Vol. 7 Submission: <Submission Category>’. The submissions by students of NLSIU must be made to vasuaggarwal@nls.ac.in. 
  • All submissions must be in MS Word format (.doc) or (.docx), with Times New Roman font (Main text: size 12 and double spaced, footnotes: size 10 and single-spaced).
  • All manuscripts must be accompanied by a covering letter with the name(s) of the author(s), institution/affiliation, the title of the manuscript, and contact information.
  • An abstract of not more than 250 words shall have to be provided.
  • Co-authorship (up to 2 authors) is permitted.
  • No biographical information or references, including the name(s) of the author(s), affiliation(s) and acknowledgements should be included in the text of the manuscript, file name or document properties. All such information may be incorporated in the cover letter accompanying the manuscripts.
  • The NLSBLR uses only footnotes (and not endnotes) as a method of citation. Submissions must conform to the Oxford Standard for Citation of Legal Authorities. Please note that SCC citations for cases must be preferred wherever available.
  • Submissions are accepted for publication on the condition that they do not infringe the copyright or any other rights of any third parties.
  • Submissions made to NLSBLR shall be on an exclusive basis and must not be concurrently under consideration by any other publication.

Timeline and Procedure

We accept contributions to the BLR Forum on a rolling basis. BLR strives to ensure a speedy and efficient review process. We follow a system of two rounds of review by the Editorial Board for publication in the BLR Forum. Authors should be prepared to make suitable changes to their articles as required by the Editorial Board before publication.

PURPOSE

An internship is an opportunity for a student to secure first hand and practical work experience under the guidance of a qualified and experienced Supervisor/Mentor. It also aims at active participation in the learning process through experimentation and putting into practice the knowledge acquired in the classrooms. Gujarat Maritime University (GMU), an endeavour by Gujarat Maritime Board (GMB), the state regulator for the ports and maritime activities in Gujarat. The University has been conceived by visionaries to address the burgeoning need of skilled the workforce in the ever-changing dynamics of the maritime sector.

The University has commenced its academic journey from 2019 with the establishment of its first School – School of Maritime Law, Policy & Administration (SMLPA), which offers LL.M and Post Graduate Diploma programmes in Maritime Law and International Trade Law. In pursuit of creating an institution of global standards, GMU has collaborated with internationally prominent institutions like Erasmus University, STC International and many more such alliances shall be forged in time to come. For the larger benefit of the student community and with a view to enrich the quality of research on maritime law in India, the Gujarat Maritime University has decided to notify these “Internship Guidelines”, to provide a framework for engagement of Interns for a period of 6 months.

ELIGIBILITY

Must be a Law graduate from recognized universities

OR

Law student pursuing 5 year law course from recognized universities and are in their 4th/5th year.

OR

ii) Law student pursuing 3 year law course from recognized universities and are in their 3rd year.

Applicants having exposure in the area of intended internship with good academic background and having higher qualification, based on need shall be given preference.

RESPONSIBILITIES

The Applicant may be asked to undertake tasks that will involving assisting with research projects or initiatives in public engagement. While the university shall attempt to account for the interests expressed by the interns, the university reserves the right to allocate tasks as it deems fit as per its requirements. All members of the university undertake administrative duties and therefore interns will also be expected to assist in administrative matters. The present is an online internship and the Interns will be required to observe the working hours of the university and work by logging in from home.

DURATION OF INTERNSHIP

Internship will be for 6 months. The internship may be extendable depending on the performance of the applicant and subject to the requirement of Gujarat Maritime University. The area of Internship is as follows:-

HOW TO APPLY

  • Curriculum Vitae
  • Cover Letter indicating the programme enrolled in, current year of study, name of the university and the exact dates of the internship.
  • Statement of Purpose of not more than 500 words explaining their interest in interning with the Centre.
  • Shortlisted Applicants will be called for an online interview and final selection will be made after the online interview.

We shall endeavour to inform selected candidates at least 1 weeks before the commencement of the internship. Only successful applicants will be contacted and if you do not hear from us within 30 days of submitting your application, please assume that your application has not been successful.

SELECTION

  • The Interns will be shortlisted and selected by the respective organisations/Groups/Divisions for their concerned domain.
  • For selection of interns, online Interview, may be conducted, if deemed necessary. No TA / DA shall be paid to candidates for attending the personal interview.
  • Selected candidates will be informed.

CODE OF CONDUCT

The  Intern  appointed  by  the  University shall observe the following Code of Conduct, which shall include but not be limited to, the following:

  • The Intern shall follow the rules and regulations, which are in general applicable to employees of the University.
  • The Intern shall follow the confidentiality protocol of the University and shall not reveal to any person or organization confidential information relating to the University.
  • The Intern shall not claim any intellectual property right, of work done at the University and has to strictly maintain the confidentiality of University’s intellectual property. Any violation/infringement will be viewed adversely against the Intern as well as the institution to which he/she belongs and may invite appropriate action.
  • The students and the Sponsoring Institution concerned shall have no claim whatsoever on the results of the project work. The University retains all intellectual property rights in patents, designs, software copyright (source code) and publications, if any, that may be generated during the course of project work.
  • Interns may, with the prior permission of the University, present their work to academic bodies and at seminars/conferences. However, even for this purpose information that is confidential to the University cannot be revealed under any circumstances.
  • Any papers and documents written and/or published by the Intern should carry the caveat that the views are the personal views of the Intern and do not represent or reflect the views of the University.
  • Interns will follow the advice given to them by the University regarding representations to third parties.
  • In general, an Intern may not interact with or represent the University vis- à-vis third parties. However, some Interns may specifically be authorized to interact with third parties on behalf of the University depending on the nature of their roles and responsibilities.
  • No Intern shall interact with or represent the University to the media (print and electronic).
  • Interns will conduct themselves professionally in their relationship with the University and the public in general.
  • Interns are required report to the University online and shall remain active from 09.00 am to 05.30 pm, unless otherwise permitted by the Supervisor/Mentor through email.
  • In the event of unsatisfactory performance, the concerned Intern may be advised by the University to discontinue the project work, before the completion of the term of internship.

PLACEMENT

  • Every batch of Interns or individual Interns, as the case may be, will have a Supervisor/Mentor from the University.
  • The internship is neither an employment nor an assurance of an employment with the University.

SUBMISSION OF REPORT/PAPER

  • Work plans and work schedules shall be developed by Supervisor/Mentor and the Interns shall invariably adhere to the same.
  • The Interns will be required to submit a Report on the work undertaken at the end of the internship to this University.
  • The project report prepared for the Sponsoring Institution in which the Intern is enrolled and for the University is required to be identical in all respects.

REMUNERATION

Interns will be paid a stipend of Rs 10,000 per month (Rupees Ten Thousand Only), subject to satisfactory performance, duly certified by his Supervisor/Mentor.

CERTIFICATE OF INTERNSHIP

Certificates will be issued by the University to the Interns on the completion of internship and submission of Report duly countersigned and accepted by the Competent Authority.

TERMINATION

  • The University may disengage an Intern if the University is of the view that the services of the Intern are no more required.
  • The University may terminate the services of the Intern at any time without assigning any reasons and with immediate effect.
  • If the Intern decides to disengage from the University, he should provide 2 weeks’ prior notice.
  • Up on termination, the Intern must hand over to the University, any papers, equipments or other assets which might have been given to the Intern by the University in course of his project work with the University.
