The Role

The Associate contributes to the success of the Research and Ratings Support team, by providing a range of data and analytic services that contribute to the overall credit analysis functions performed by the MIS analytic teams. This internal facing role is part of the team that works directly with rating and research support analysts, prepares data and various discrete pieces of analytical work such as spreading, data gathering and analysis for credit ratings, research analytical market outreach and presentations, under the guidance of the RRS and R&R teams. This role provides opportunities to take additional responsibilities at key interval. Candidates will require solid accounting background with strong focus in financial analysis. They will be expected to demonstrate their ability to work effectively in a team environment with matrix reporting. The ideal candidate for this role will possess strong organizational skills, demonstrate attention to detail, and enjoy working in a collaborative team environment.

Key Responsibilities

  • Prepare a variety of discrete credit process inputs, perform preliminary analyses to identify trends in data, and apply reasoning to the completed work product.
  • Perform financial statement analysis using accounting and finance principles to read and understand financial statements and other disclosures related to debt issuers’ performance. 
  • Apply Moody’s relevant methodology standards and requirements to financial data and make appropriate adjustments.
  • Create a variety of standard initial work package items that serve as starting point to the ratings and research process including data, spreadsheets, charts, and tables:
  • Update financial spreadsheets, charts and tables:
    • Identify trends in data and apply reasoning to work being completed
    • Initiate/escalate deeper reviews when necessary
  • Prepare presentation materials for outreach activities.
  • Provide support for RRS and R&R in monitoring / surveillance of Moody’s rated issuers.
  • Support monitoring of analyst credit portfolios through news and industry source tracking and highlight key issues requiring further analysis.

The Role

The Foundation is recruiting a highly skilled and dynamic Legal Programme Manager to grow and strengthen our award-winning TrustLaw programme across Asia. We have a growing presence in the region but see great potential for continuing to broaden and deepen the reach of our service, particularly across the Foundation’s focus areas of media freedom, inclusive economies and human rights. The position would be based in Mumbai and work closely with our Asia Legal Officer, who is based in Mumbai, and our Asia Programme Officer, who is based in Thailand, both of whom provide support to TrustLaw’s activities across the region.

Responsibilities may include:

  • Designing and implementing strategies to expand and strengthen the TrustLaw service, ensuring we serve the best NGOs, social enterprises and legal teams and we deepen TrustLaw’s work across the focus areas of media freedom, inclusive economies and human rights.
  • Managing relationships with key TrustLaw members and facilitating their engagement with the service, through hosting events and regular communications.

ABSTRACT

Child sexual abuse is a dark reality that is increasing in India and with numerous harmful impacts. It is a universal and human rights issue. It was not conceded as a serious crime before the “Protection of Children from Sexual Offences Act, 2012”. Child sexual abuse includes the provision concerning child rape, harassment and pornography. This article highlights the types of child sexual abuse and legal provisions related to child sexual abuse.

Introduction 

Child sexual abuse means the physically or mentally ill-treatment with a minor or a child with sexual intention. Children are abused by an outsider (unknown to the child) or an insider (family member and relatives). In India, many cases of child sexual abuse are not recorded because many parents prefer to stay quiet. 

It happens when a person uses a child for his/her sexual indulgence. Child sexual abuse is in the form of physical contact and non-physical contact. The child does not have the authority to give consent. Consent or dissent both are covered under child sexual abuse.

Various kinds of child sexual abuse:

  • An adult revealing their private parts and forcing the child to do the same. 
  • An adult touching child’s sexual organs and compelling them to do the same. 
  • An adult initiating sexual intercourse with a child with or without consent.
  • An adult showing or encouraging a child to hear and watch pornographic material.
  • Obscene phone calls and indecent messages.
  • Sharing and preserving indecent images of children. 
  • Making child to listen sexual content that harms their mental and physical health.
  • Adult married to minor and minor to minor is considered a forced relationship.

Laws relating to child sexual abuse

Before 2012, In India, there was no particular law for child sexual abuse. It was governed by the various provisions of the IPC. Section 377[i] deals with the sexual intercourse against the nature, Section 354 states the assault or criminal force on women with intention to indignant her modesty[ii]. Sec.509 deals with insulting women through word, or gesture or showing object which is inappropriate with the intention[iii]. Section 374 defines rape[iv]. The Protection of Children against Sexual Offences Act, 2012 was enacted by Parliament to save children or minors from sexual abuse and it is gender neutral.

Provision contained in POSCO Act

  • Section 19 of the POSCO Act, states that the reporting of the cases child sexual abuse is obligatory.
  • Section 30(iii) of the Juvenile Justice Act, 2015 states that when a child has been abused sexually, then Child Welfare Committee (CWC) should take actions for child’s rehabilitation. Such a case must be reported to SJPU or local police under POSCO Act, 2012.
  • Section 19(6) of the POSCO Act, deals with sexual offence against a child and mandates that a report of the case should be presented in front of CWC within 24 hours after the filing of the case[v].
  • Rule 4 (7) of POSCO Act, obliges the CWC to assist child and the family during investigation.
  • The Special court should determine the age of child define under Sec. 34(2) of POSCO Act[vi].
  • Section 40, POSCO Act 2012 deals with the victim child’s right to receive free legal counsel during the trial[vii].

Others-

  • Minor has the liberty to state his statement only where he is comfortable.
  • To provide a speedy trial and video recording to ensure confidentiality.
  • The child should be medically examined by a female doctor, in the presence of a person whom the child trusted, with his/her guardian consent.
  • Contact between the victim and the accused should be avoided during video recording.
  • The accused defender can ask questions but those questions would be asked through a judge to a juvenile.

Punishment under POSCO

  • Section 4 of the POSCO Act deals with the punishment for penetrative sexual assault, the accused shall be punished not less than 7 years or which may be extended to life imprisonment[viii].
  • If a trusted authority or a person or police officer is committed an aggravated sexual assault with child, he will be punished under Sec.6 of the POSCO Act[ix].
  •  If a person has committed non-penetrative assault, then he will be punished under Sec.10 of the POSCO Act[x].
  • Section 12 of the POSCO Act prescribed punishment for three years with a fine[xi].

Further, The Act prescribes punishment in accordance with the gravity of the offence. Storing pornographic material related to the child is an offence, punishment for which imprisonment is in description form, which may be extended to three years or fine or with both.

Landmark Judgements

Ghanshyam Misra v. The state[xii]

In this case, Ghanshyam Misra was the school teacher of a 10-year-old and raped her at the school premises. The schoolteacher is the trusted authority of the child. The court sentenced the accused for seven-year imprisonment with a fine and ordered compensation to the father of the girl.

State v. Pankaj Chaudhary[xiii]

In this case, the court held the accused liable only for ‘outraging the modesty of a woman’. The case revolves around the digital penetration of anus and vagina of a girl child. Before 2012 digital penetration was not recognized as an offence under IPC. 

Misuse of POSCO Act

Many cases were reported based on false allegations. The Kerala High Court has held that the petitioner misused the provisions of the Protection of Children from Sexual Offences Act (POCSO Act) so she will be liable. The petition was filed by the victim’s mother. The allegation was that her 16-year-old daughter was alone at home the accused came to her house and hold her. In the investigation, the police officers found that the accused was far away from her house on the incident day. The court held that the allegation on the accused was fictitious. According to Section 22 of the POSCO Act, police can take action against the petitioner. The court dismissed the petition[xiv].

Conclusion

Sexual abuse of a child is a serious crime. POSCO Act has changed the scenario of child sexual abuse in India as prior to it there wasn’t any specific law dealing with said issue. Yet, the need to improve the trial and make it child-friendly is often felt.

JOB DESCRIPTION

KEY RESPONSIBILITIES

  • Drafting and vetting of program & film production related contracts, film & program distribution and syndication contracts, rights licensing contracts, , Artist Agreements, , Content  Acquisition Agreements (Films and Programs) , Marketing Agreements,  and all other miscellaneous agreements
  • Conduct due diligence of movies to be acquired.
  • Providing legal assistance related to legal cases from time to time.
  • Do legal research.
  • Drafting rules and regulations for all the marketing contests for consumer engagements and activities which are held on our channels, from time to time; all documents pertaining to  reality shows.
  • Draft legal notices/responses etc. from time to time.
  • Assist in litigation pertaining to the business.

QUALIFICATIONS

  • preferred from top tier law schools, such as the National Law schools, ILS Pune, Symbiosis, Pune.

KNOWLEDGE AND SKILLS

  • Demonstrate (hands on experience) in contract drafting, good negotiation, and execution skills i.e., ability to draft, negotiate and close transactions independently
  • Good contract drafting skill sets.
  • Good knowledge of Contract Act 1857, Copyright Law and Trademark laws, Cable Television Networks (Regulation) Act1995, TRAI Regulations
  • Well versed with various content regulation such as the Self-Regulation Code framed by the IBF and the BCCC Guidelines, the ASCI, NCPCR guidelines, Should have excellent research skills.
  • Good communication skill sets required

Basic Function

To assist the Legal Function. Should be capable of handling multiple legal assignments and ensure minimization of legal risks to the organization. Meeting deadlines with minimum turnaround time in handling legal matters.

Essential Functions

Support and collaborate with EXL Legal team in:

1) Contracts:

Reviewer/ negotiator for commercial agreements, including client Master Services Agreements, SOWs/ Work Orders, Vendor Contracts, Facility Leases, Software License Agreements, Service level agreements, NDAs and RFPs.

Ensure legal risks are addressed while balancing business needs and objectives.

Ensure contracts are negotiated within EXL contracting standards, while facilitating deal-to-deal specific exceptions and customizations and pro-actively working with Business team members to creatively solve issues.

2) Indian law issues: Legal research and responding to legal queries facing the Indian entities, covering all local laws and regulations. Supporting the corporate secretarial team from time to time.

3) Employer Employee relationships: Handling employee matters, researching and advising on applicable laws concerning employment, providing trainings, answering legal queries and satisfactory resolution of employment issues.

4) Managing and driving company litigation in India, across the board.

5) Specific Projects: Assist with Special Projects as the need arises to support the businesses strategic growth while keeping within the acceptable risk profile. Ability to take ownership of projects and “run with them” to completion.

6) Talent Management: Conducting training and awareness sessions on upcoming legal and compliance areas. Ensure team engagement; provide team development, orientation and mentoring. Continue to build and improve processes to minimize team conflicts.

Job Purpose

  • Independently advise and handle legal issues relating to all aspects of the Bank’s business, commercial and finance operations in accordance with best practice methods to ensure the Bank’s interests are fully protected and to mitigate risk and minimize exposure to litigation.
  • Co-ordinate and liaise with external counsel to obtain advice (in a cost efficient manner) on particular legal matters and issues.
  • Negotiate contracts, advise and manage legal aspects of corporate, commercial and finance transactions on behalf of the Bank.

Key Result Areas

  • Reviewing, drafting of documentation relating to corporate and banking facility agreements, finance security documents, Islamic finance documents and commercial arrangements including, but not limited to, credit facility agreements, pledge and mortgage agreements, services agreements, syndication agreements, escrow trust account agreements, supply agreements, joint venture agreements, shareholders agreements, articles of association, all types of letters of credit, bonds and guarantees, pursuant to Loan Market Association or other internationally accepted standards, as may be relevant and applicable.
  • Advising on legal and regulatory matters pertaining to the Bank with respect to the Central Bank and other governmental authorities (Economic Department, Emirates Securities and Commodities Authority, Freezone Authorities, etc.) local agencies and public authorities.
  • Keeping abreast of all legal developments and other official practices and procedures in the UAE and GCC generally on a continuing basis, reviewing legal manuals and reports, court judgments and amendments to various statutes and legislation, promulgation of new laws, regulations, presidential and ministerial decrees, by-laws and relevant orders.

Knowledge, Skills And Experience

  • Law graduate with 6–10 years of post-qualification legal experience in the corporate/commercial/finance practice areas (litigation experience would also be a plus) as a member of a national/international law firm and /or legal department of a bank, preferably in the United Arab Emirates.
  • Well versed with good practical working knowledge of the laws of the UAE is essential especially corporate/commercial/banking laws and regulations of governmental authorities (Central Bank, Emirates Securities and Commodities Authority, Real Estate Regulatory Authority and other similar bodies)
  • Experience in litigation and in handling legal cases and filing precautionary attachments before the courts and public authorities would be an added benefit.
  • Ability to work efficiently under pressure and to handle several matters at the same time.
  • Ability to think commercially and outside “the box” and to adopt analytical solutions to problems.
  • Individual should approach assignments with a sense of enthusiasm and purpose.
  • Individual should demonstrate agility and be fully committed to quality and service levels.

A salient illustration is the HIV/AIDS epidemic, which was most effectively countered through key public health and social interventions, supported by evidence-informed and rational deployment of legislation, enforcement and policy guidance. This use of the law is grounded in the knowledge that empowering those who are most vulnerable is the most effective way to stem the spread of HIV.

The Centre for Health Equity Law & Policy (C-HELP) is an initiative that takes these lessons and applies and adapts them across other health contexts and priorities. It also aims to use law in conjunction with other disciplines – economics, sociology, anthropology, public health, communication, governance etc. – to find holistic and systemic solutions to inequities in health.
