About the Conference

United Nations in its report has identified climate crisis, accelerated urbanization, demographic shift, amplified individuals, economic power trends and emerging technology as six megatrends that have a lasting influence on the course of sustainable development. In addition to these, emerging trends such as Artificial Intelligence, Augmented Reality, amongst many need trans-disciplinary scrutiny through the prism of multifarious laws in the realms of IPR, Healthcare, Employment, Environment, Corporate Laws and other legal and allied subjects.

The juxtaposition of demographical or technological development and socioeconomic landscape or uses of scientific advancement in Environment such as in Zero Carbon Technology are a few examples of how multi-faceted and transdisciplinary these issues are.

Therefore, the aim of this Conference is to link a range of megatrends to one another and offer a larger picture on how these are shaped by global and national policies and affect stakeholders from a macro to the micro-level.

Conference Proceedings

All submitted Conference Papers would be blind peer-reviewed by the Review Committee and the selected Papers would be published in the Conference Proceedings to be published by the School of Law and in the Peer-Reviewed Ideal Journal of Legal Studies with ISSN No. 2231-0983.

The Certificate of Presentation and Participation/Attendee will be awarded to the Participants.

  • The participants shall forward their Paper as a reply to the confirmation mail sent by the organizers and the subject of the same shall be changed to“Submission of Paper for National Law Conference”.
  • The selected participants shall present their paper(s) on the day of the conference.

Submission Guidelines

Abstract

  • The maximum word limit must not exceed five hundred (500) words and the same shall be inclusive of relevant keywords.
  • The Author(s) shall specify the Title of the Paper, Name(s) & Designation of the Author(s), E-Mail Address(es) and Contact Number(s).
  • All Abstracts should be submitted through E-Mail only.
  • The Author(s) should clearly and precisely indicate the Sub-Theme on which the Abstract is based.

Note: The Abstracts shall be screened by the Review Committee. The Author(s) of the shortlisted Abstract(s) shall be intimated accordingly through mail.

Research Paper

  • The maximum word limit of the Manuscript must not exceed Four Thousand to Ten Thousand (4,000 – 10,000) words (inclusive of the abstract and footnotes).
  • The Paper must be accompanied by a cover letter which shall include the following details of the Author(s):
    • Full Name(s)
    • Professional/Educational Details
    • Institutional/Organizational/University Affiliation
  • The Paper should be in Microsoft Word .doc/.docx formats in Times New Roman Font with the font size of 12 along with 1.5 spacing. The font size for the footnotes shall be 10 along with zero spacing.
  • Alignment – Justified, No Page Borders, Margin 1 inch on each side.
  • The heading encompassed in the main text of the paper shall be divided under different levels and the same shall be formatted as follows:
    • Level One: Numbered and in the centre.
    • Level Two: Left aligned and in bold letters.
    • Level Three: Left aligned and italicized.
  • The writings must conform to the Indian Law Institute style of citation.
  • The Paper must begin with the Subject Matter of the Study and shall provide:
    • Exhaustive Literature Review;
    • State the Problem and Hypothesis, and
    • Examine the Hypothesis and provide Conclusion and Suggestions.
  • The submission should be the original work of the Author(s), and should not have been submitted for publication/published elsewhere in any form.
  • The submission is subject to strict plagiarism check and any unattributed work is liable to be rejected.

Career Point University Hamirpur was established by the Government of Himachal Pradesh vide Act No. 12 of 2012 under Sec2 (f) of the UGC Act 1956. About school of legal studies & governance 

The School of Legal Studies and Governance was set up by the University in 2014 in which BALLB program is offered to students. Since 2015, the postgraduate program in law i.e. LLM is also being offered. Taking further the cause of legal education, PhD degree course in Law has also been offered from the Academic Session 2019-20. The State Legal Service Authority has approved the Legal Aid Clinic in this University and the same is working since 2014. About the webinar 

The Himalayas is one of the youngest mountain regions of the world. The land mass has not found its final form and its ecosystem is one of the most fragile in India. In the lap of Western Himalayas lie the states of Jammu & Kashmir (J & K), Himachal Pradesh (HP) and Uttarakhand. These mountainous states have their unique cultural and social systems. These are the states of villages, which are mostly rural. The status of women in any civilization shows the stage of evolution at which the civilization has arrived. The term status includes not only personal and proprietary rights but also duties, liabilities and disabilities. In the case of an Indian woman it means her personal rights, proprietary right, her duties, liabilities and disabilities vis-a-vis the society and her family members. ‘Status’ is correlated to the participatory right and obligations of women in the managing of society; there studies examine the role assigned to them by tradition, religion, ideology and the stage of economic development. The social and political development of women has a direct effect on future. The future world is dependent on their present development. The society has ratified their rights. It was during the twentieth century that the concept of child rights emerged. The rights perspective is embodied in the UN Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), adopted in 1979 by the UN General Assembly, is often described as an international bill of rights for women, is a landmark in international women rights legislation. It shifted the focus to the ‘rights’. The rights approach is primarily concerned with issues of social justice, non discrimination, equity and empowerment. The Convention provides the basis for realizing equality between women and men through ensuring women’s equal access to, and equal opportunities in, political and public life including the right to vote and to stand for election, as well as education, health and employment. The Convention is the only human rights treaty which affirms the reproductive rights of women and targets culture and tradition as influential forces shaping gender roles and family relations. It affirms women’s rights to acquire, change or retain their nationality and the nationality of their children. States parties also agree to take appropriate measures against all forms of traffic in women and exploitation of women. 

Increasing incidents of crime against women, emotional or physical, raising the concern world over. There are women protection laws and policies at the national level to address these kinds of issues, to strengthen women protection system and promoting positive social norms in all contexts to prevent and respond to violence, exploitation and abuse directed at women. The constitution of India granted equality to all sections of society and also authorized the state to do positive discrimination for uplifting deprived sections of Indian society. The fundamental rights and directive principles of state policy are embedded in our constitution for upliftment of deprived sections of society. 

Irony is, despite so many laws and policies for the protection, women are still at the verge of danger and uncertainties. The challenges this vulnerable group is facing are immense and need to be addressed effectively.

  • Citations may be included either by adding footnotes (OSCOLA) or hyperlinking the reliable internet source in the main text itself.
  • Further, if the author relies on a specific part of a document to support an argument,  pinpoint citations must be included.
  • Authors are advised to keep their articles concise and precise to enhance the effectiveness of their posts. The word limit should ideally range from 1200 – 1500 words (excluding footnotes).
  • Submissions should not contain advertising or marketing material. Posts summarising (and possibly linking to) alert memos and similar current awareness pieces prepared by law firms and other service providers will not be considered for publication.

About UPES

Established in the year 2007, UPES has emerged as a premier institution and is the first Indian University specializing in Energy Laws. UPES School of Law has been successfully organizing Surana & Surana and UPES School of Law National ‘Insolvency Law’ Moot Court Competition for the past three years. The competition aims at creating opportunities for learning and testing one’s skill in the field of insolvency law. 

About the Moot 

Surana & Surana and UPES School of Law National Insolvency Law Moot Court Competition has been conceived with the aim of creating opportunities and platform for discussion of developing jurisprudence on emerging trends in Insolvency Law besides developing cutting-edge skills in research, writing, and advocacy. 

Since its inception, the competition has grown by leaps and bounds with excellent participation from all over the country. The university has been a host with utmost zeal and drive for all of the past editions, and plans to continue the tradition with the same affection for knowledge this year too. 

In the light of the pandemic, the 4th edition will be held virtually this year, but that isn’t going to stop us from making it a memorable one. The platform for the competition is via virtual conference. 

Eligibility, Team Size and Other Information  

  • The competition is open for students who are pursuing LLB three year/five- year course during the current academic year.  
  • Each team should consist of 3 members. This number cannot be modified under any circumstances.  
  • There shall be 2 speakers and 1 researcher designated for each team. The researcher shall be allowed to argue with prior permission of the court and National Administrator in case of illness of the designated speakers.  
  • Teams should not disclose the identity of their institution; such disclosure shall invite penalties including disqualification. The decision for the same shall be at the discretion of the National Administrator.

The program will consist of plenary, half plenary, invited and contributed papers falling broadly within the scope of the conference. Some of the invited papers maybe tutorials in nature from keynote speakers, while others will review recent work in specialised fields.

The theme of the Seminar

Cyber Law is a relatively new field that draws from traditional law. It is becoming an increasingly important field in the modern technological world. It is multi-disciplinary, covering criminal and civil issues ranging from financial crimes to cyberbullying. Privacy, control, and access are all areas with which cyber lawyers regularly engage. As a quickly developing and growing field, cyber law promises to ensure more diverse possibilities in the future. The eminent English jurist Salmond has rightly observed that law seeks to regulate the conduct of individuals in society.

Cyber Law can be described as an endeavour to integrate the challenges presented by human action on the internet with legacy systems of laws applicable to the physical world. Cyber law has three basic building blocks-netizens, cyberspace and technology. It covers a broad area, encompassing many subtopics as well as freedom of expression, digital and electronic signatures, access to and utilisation of the internet, data protection and online
security or online privacy. Generally, cyber law is alluded to as the law of the web, but the term does not have a fixed definition.

The main reasons to enact cyber laws are, firstly, to prevent computer abusers from carrying on their illegal activities for personal gains; secondly, to prevent political rivalry so that innocent people do not become victims of their criminal acts. The internet is not just a world full of information, friends, fun, education and sports, but also a world full of drug dealers, cyber stalkers, psychopaths and even recipes to make bombs, and therefore cyber law plays a vital role in maintaining cybersecurity.

Therefore, the Centre for Excellence, through its Seminar, aims to disseminate legal knowledge pertaining toCyber Law.

Format of the Seminar

  1. Abstracts of 250 words will be invited, inclusive of 5 keywords.
  2. Upon selection of abstract and communication of acceptance to the author, the submission of the research paper will be invited.
  3. Submissions in the form of research papers, 2000-5000 words in length, inclusive of footnotes, are invited from professionals, academicians, research scholars, and students.
  4. A presentation will be made by the participants through PPT or any other means of presentation, upon selection of their manuscript.
  5. Further, we will strongly encourage the presentation of new and unpublished work.
  6. The seminar shall be conducted on an online platform.
  7. The top 3 presenters will receive cash prizes and otherawards.

  • Original research papers are welcomed on the above-mentioned topic but not restricted to the sub-themes as given.
  • The paper can be co-authored. However, a maximum of three authors per entry is allowed.
  • The author(s) shall specify in their submission:
    • Title of the paper with the sub-theme.
    • Names of author(s).
    • Name of the College/University.
    • Email address and contact number.
    • Sub-theme under which submission is made.
  • The Abstract and the Full paper should be submitted in .doc/.docx format with the following specifications:
    • Font Type: Times New Roman
    • Font size: 12 pts
    • Line spacing: 1.5
    • Footnotes Font Type: Times New Roman
    • Footnotes: Font size: 10 pts

About the National Opinion Writing Competition

Right to Life is one of the basic as well as a fundamental right without which other rights cannot be enjoyed. But, if the person has a right to life, the question arises whether the same person can also exercise his right to die. Especially during the pandemic, we have noticed an enormous death doll in India during the second wave.

Hundreds of unaccounted corpses had been found in the river Ganga which has been burned and buried without any cremation rituals. Hence, in the present time, it is very important for us to evaluate whether Indian Citizens can exercise the right to die with dignity.

Topic

The topic for the National Opinion Writing Competition is ‘Right to die with dignity: A Fundamental Right?’

Submission Guidelines

  • Only undergraduate law students can take part in the competition.
  • All submissions must be original and unpublished.
  • One author can send only one entry.
  • The write-up shall be in between 500-2000 words.
  • The content shall be written in Times New Roman with a font size of 12 and line spacing shall be 1.5 with appropriate footnotes.
  • The write-up shall be in ‘.doc’ or ‘docx’ form and it shall be attached in the following link along with the basic details for registration.
  • The content shall be judged on the ground of novelty, reasoning, use of language and coherence.

Format of the Main Text & the Footnotes

  • Times New Roman font, in font size 12 is prescribed for all articles.
  • Further, the footnotes shall be in font size 10 and in the Times New Roman font.
  • A line spacing of 1.5 for the main text and 1.0 for the footnotes is to be followed.
  • All articles are to be sent in either doc or Docx format. Any submission in pdf form shall not be accepted.
