Dr. Ram Manohar Lohiya National Law University is an institute for law in Lucknow, Uttar Pradesh, India. Dr RMLNLU was established in the year 2005, and since then, has been providing undergraduate and post-graduate legal education.

About the Journal Committee

The Committee was constituted with the objective of promoting legal research and writing. Apart from conducting the RMLNLU International Legal Essay Writing Competition every year, the Committee annually publishes two peer-reviewed journals – the RMLNLU Law Review and the RMLNLU Journal on CMET (Communication, Media, Entertainment and Technology) Law.

Both these journals publish articles, essays, case notes/comments and book reviews from contributors all over the world. The RMLNLU Law Review also runs a blog that provides a platform for people in the field to express their opinions on contemporary legal issues.

About the Journal

The RMLNLU Journal on Communication, Media, Entertainment & Technology Law (hereinafter ‘the Journal’) is an annual, student-edited, peer-reviewed law journal published by the Journal Committee of Dr. Ram Manohar Lohiya National Law University, Lucknow.

Through this Journal, the Committee aims to foster the spirit of writing and set in motion a discourse among knowledgeable intellectuals from various fields of law.

The Journal Committee is pleased to announce the call for papers for The RMLNLU Journal on Communication, Media, Entertainment & Technology Law, Volume IX.

This is a theme-based journal and only accepts submissions pertaining to the same.

Call for Papers

The Journal accepts submissions from law students, academicians and legal professionals all over the country and abroad in the form of:

  • Articles: 5000-7000 words. (These are evaluations of specific contemporary issues and aim at conceptualizing the issues in a unique and unconventional manner. The assessment of contemporary issues shall be appreciated, though not mandatory).
  • Case notes/comments: 2000-3000 words. (These are assessments of the aim and legal impact of contemporary judgments and legislations).
  • Book Reviews: 2000-3000 words. (Entries submitted under this category may present innovative evaluations of present literature).
  • Essays: 4000-5000 words.

The submissions may be on any contemporary legal issue connected with media law and its allied fields of communications, entertainment and technology. The authors are expected to adhere to the prescribed word limit as indicated above.

Note: The prescribed word limits exclude Abstract, whose word limit has been prescribed in the guidelines that follow, and footnotes, wherein speaking footnotes must be avoided wherever possible.

Each of these entries shall be required to conform to the set of guidelines that follow.

The formatting shall be as per the following:

All the sources in the footnotes must be properly cited strictly in accordance with the latest OSCOLA (4th edition) format. No endnotes or speaking footnotes (descriptive footnotes) are allowed.

General Instructions

  1. The submission should be original and non-plagiarised. They should exhibit originality in thought, critical evaluation, and careful interpretations. Submission of a paper shall be taken to imply that it is an unpublished work and is not being considered for publication elsewhere.
  2. Co-Authorship to a maximum of two members is allowed. However, co-authorship is not allowed in “book reviews” and “case notes/comments”.
  3. Acknowledgement and Declaration by the author(s) need not be included.
  4. The contents should in no way, directly or indirectly, indicate or reference the identity of the author(s).
  5. The author(s) must send in the cover letter in the body of the mail, which must contain all the relevant biographical details (Name of the author(s), their degrees, Designation, Name of College/University/Institution, Postal Address(es), Phone Number and email ID). A separate attachment as a cover letter will not be entertained.
  6. The authors must attach only one manuscript to the mail which must include the abstract and the main content of the paper. The authors must refrain from adding any other information (such as personal information, declarations) in this manuscript. 
  7.  The file name of the attached manuscript must be the name(s) of the author(s).
  8. The subject title for the mail must be ‘Article/Essay/Case Comment/Book Review for Volume IX’. 

Declarations

  1. Editors’ decisions shall be final and binding. They reserve the sole rights to the publication of the selected articles in addition to, inter alia, any edits/amends/reproduction.
  2. The contributions presented to and accepted for publication and the copyrights therein shall be the intellectual property of the Journal Committee, Dr. RMLNLU.

The submissions may be emailed to cmet.rmlnlu@gmail.com in Microsoft Word (.doc or .docx) format. Please note, that only one submission per author or a team of co-authors is permissible. In case of more than one submission, only the one received first would be considered for review.

Submission Deadline and Review

The deadline for submission of the manuscript is February 6, 2022, by 11:59 PM.

There shall be a rigorous review process comprising 3 stages and spanning 45 days. The authors shall be intimated about the status of their manuscript at every stage.

Submission Guidelines

  • Subject Matter: The CALR Journal of Applicable Law & Jurisprudence accepts research/scholarly work on every legal subject matter. The editorial board, upon the review of the work, sorts the paper into the appropriate chapters such as CSCLI, CCFL, CSDR, CTL & CEA.
  • Submission must be in form of descriptive, analytical or critical analysis of the particular subject matter.
  • The submission should reflect original, unpublished work and not under review on any other platform. A maximum similarity of 15% is allowed. Non-adherence to this rule shall result in the rejection of the research/scholarly work summarily without any chance of revision.
  • Note: If an author withdraws his submission after initiation of the review process (within the seven-day deadline) he can be blacklisted from further publications, at the discretion of the Managing Editors or Project Heads.
  • Submission must ideally be limited to a length of 3000 words to 7000 works, inclusive of abstract.
  • Note: Every research/scholarly work shall consist of a limited 300 to 400 words abstract.
  • Format:Submissions should be made only in Microsoft Word (.docx) format. The submission should adhere to the following formatting style. Font: Times New Roman, Font size: 12, Line spacing: 1.5” (For endnotes Font size: 10, Line spacing: 1”)
  • Relevant sources such as judgments, laws, treaties, news articles and other legal texts must be added as hyperlinks in-text (if possible) but must contain proper citations adhering to the uniform Bluebook 20th Edition citation style.

About the Centres

Centre for Study of Contemporary Legal Issues (CSCLI) established under CALR seeks to provide numerous insights and views into contemporary legal issues and encourage conversation about the same. Centre for Study of Dispute Resolution

Dispute resolution is a term that refers to a number of processes that can be used to resolve a conflict, dispute or claim. Dispute resolution may also be referred to as alternative dispute resolution, appropriate dispute resolution, or ADR for short. It is becoming the primary function of the legal corporate world. Parties often find themselves at dispute, which needs to be addressed.

Centre for the Study of Dispute Resolution follows the latest development in the said field, to bring the readers the idea of mastering managing a dispute. Dispute resolution many times, interchangeably used with conflict resolution, although conflicts are more deep-rooted and lengthier than disputes. Even many claim settlements are part of a negotiation or dispute. This centre does not distinguish between Dispute, Conflict and Claims, and covers all three subject matters.

The research area focuses on laws such as Insolvency and Bankruptcy, Contracts, or any law in which a dispute can be addressed. This centre focuses on Arbitration, Mediation, Negotiation, Traditional litigation as a mechanism to dispute resolution, etc and their impact on the corporate bodies.

The centre is for Dispute resolution enthusiasts and welcomes law students, and practising professionals to contribute their idea on the subject matter and to have a platform to keep up with recent changes.

Centre for Technology Law

Center for Technology Law (CTL) is a department under the project CALR that aims to cover under its ambit all the interconnection of law and technology – taking up a vast number of issues under its wings, from blockchain technology, national and international cyber laws with a keen focus on the Indian scenario, along with legal integration of new and upcoming technology in the physical world.

All this is directed towards escalating awareness in the direction of techno-legal interplay. Through the means of analytical academic literature, the centre directs one’s sight on the advancement of new and development of the existing span of technology laws. In the time that’ll follow the present, technological advancements are bound to surge new skies, and the legal system can’t fall behind.

Centre for Technology Laws seeks to document this trail through the means of eminent articles, analytical write-ups and legal literature by our team. Furthermore, with the facility of monthly newsletters, our readers can be up to date with the work of our centre, effortlessly.

Centre for Environmental Awareness

The Centre for Environment Awareness (CEA) established under CALR seeks to engage in contemporary academic discussions surrounding environmental laws and judicial discourse. The idea behind the Centre for Environment Awareness is to work towards bringing about a shift from an anthropocentric attitude to an ecocentric approach through the means of academic writing and deliberations on significant enviro-legal topics.

The interplay of law and environment in India has allowed for prominent changes in the way environmental rights are perceived and the Constitution of India is one among the few constitutions in the world to imbibe rights relating to the environment within it.

The aim of the Centre is to promote awareness about various environmental issues concerning ecology, habitat, the interplay of economy and environment inter alia through case analysis, articles and newsletters. The articles published adhere to the required standard in order to contribute to the existing literature in environmental jurisprudence. 

Centre for Commercial and Financial Law

Centre for Commercial and Financial Law (CCFL) was established under CALR as one of its departments. The main objective of CCFL is to promote learning and research in the field of the commercial and financial law segment. This centre deals in Competition Law, Banking law, Insolvency Law, Taxation Law, Companies Law, Labour Law and various other laws in the field of commercial and financial law.

CCFL aims to provide a broader understanding of Commercial and Financial law to readers by the way of weekly newsletters, research articles and case analysis. CCFL is also concerned with tracking national and international changes in the field of Commercial and financial law.

This centre also encourages professionals and students to make their unique contributions. Thiru. Isari Velan Memorial National Moot Court Competition (IVMNMCC) is an annual all India moot court competition organized by the School of Law, Vels
Institute of Science, Technology and Advanced Studies (VISTAS), Chennai. The competition is one of the most sought-after mooting events among the Law schools in the city of Chennai. It started in the year 2019 and this year will be its fourth edition.

The past IVMNMC competitions have been graced by eminent Jurists and Judges namely Hon’ble Mr. Justice Kurian Joseph (Retd.), Former Judge, Supreme Court of India, Hon’ble Mr. Justice M.S. School of Law – VISTAS (Vels Institute of Science, Technology and Advanced Studies) is organizing National Virtual Moot Court Competition 2022, scheduled to be held on February 25 and 26, 2022. The present moot problem is based on Constitutional Law involving power structures and nuances of Electoral Law. The IV Ishari Velan National – Virtual Moot Court Competition seeks to provide students with a platform to develop abstract thinking, logical reasoning and practical problem-solving.

Participation Guidelines

Eligibility Criteria: Students enrolled in Five-Years Integrated Law Degree Programme or Three-Year LL.B Programme at the time of the competition are eligible to participate in the Competition. Each Law College/Law School/Law University shall nominate a maximum of Two Teams to participate from their Institution.

Team Composition: A team shall comprise of Minimum Two or maximum Three Members i.e. Two Speakers and One Researcher. The Teams shall identify the speakers and researcher during registration.

Official Language: The official language of the Competition is English.

Dress Code: The teams are required to maintain dress code as mentioned below.

  • Boys: White Shirt, Black Trousers, Black Blazer, Black tie, and Black Formal shoes.
  • Girls: White Shirt, Black Trousers/Salwar (White and Black), Black Blazer, and Black Formal shoes.

In Indian history first time the Consumer Law and Practice Chair (CLAP Chair) has been established in August 2008, at the National Law School of India University, Bangalore (NLSIU) by the Ministry of Consumer Affairs, Food & Public Distribution Department of Consumer Affairs, Government of India, New Delhi, to promote research, teaching and training in Consumer Law and Practice. From the date of establishment of this CLP chair, Prof.(Dr.) Ashok Patil is heading and administering this Chair and is the Chief Editor of this Journal.

The International Journal on Consumer Law and Practice (IJCLP) (ISSN 2347-2731) is an Open-Access, Blind-Peer-reviewed, Law journal published annually by NLSIU under the aegis of the Chair on Consumer Law and Practice, NLSIU (CLAP) since 2013. Recently Journal indexed on SCOPUS, HeinOnline, SCC OnLine, & UGC CARE List.

INTRODUCTION

The privileges of LGBTQ have consistently been an easy to refute theme in India in any case, the LGBTQ people group acquired the highest level of consideration of general society after the verdict of the Honorable Supreme Court of India in September 2018, in which gay sex has been decriminalized which had been banned under an 1860 law forced by the British. The word ‘LGBT’ represents Lesbian, Gay, Bisexual, and Transgender. Prior, the LGBTQ people group was known as a Gay people group, yet later on, different kinds of gay individuals and their networks likewise turned out to be essential for this and presently combinedly alluded to be as LGBTQ[1].

PROBLEMS FACED BY LGBTS IN INDIA

The problems faced by the LGBTQ in India incorporate –

Separation: Discrimination is the major issue for LGBTQ. They are discriminated against in terms of education, employment, entertainment, justice, etc.

Disregard: They are affronted in each part of life besides in a couple of cases like after the introduction of a kid for their gifts or to favour the recently married couple.

Discouraged: These individuals are dealt with gravely or mistreated by individuals in power. They are inclined to battle for civil rights due to their way of life as Transgender.

Youngster Nabbing: This people group consistently looks for those children/babies/kids who are brought into the world with this component of Transgender. When they come to know, they attempt to seize the kid from their folks.

Prostitution: They are compelled to enter the calling of prostitution by their local area, companions, or family members. Indeed, at times, it is seen that their folks are associated with it.

Driven away from parental home: Once their character is recognized, they are constrained and compressed to leave the parental home by society as they can’t be an integral part of ordinary local area and class.

Undesirable consideration: People focus on LGBTQ out in the open. They attempt to cause the situation by annoying, rebuffing, manhandling, or reviling them.

Dismissal of section: They are dismissed to get enter strict spots, public spots like lodgings, eateries, theatres, parks, and so forth.

Assault and verbal and actual maltreatment: This is the most widely recognized Transgender individuals face. They are inclined to confront assault followed by a physical and boisterous attack.

Absence of instructive offices: Like typical individuals, they are not qualified to take training in schools and universities. Indeed, even as far as instruction, they are dealt with unexpectedly.

STI and HIVAIDS issues: The term ‘MSM’ represents Men who engage in sexual relations with Men. Along these lines, Transgender is probably going to have issues like STI and HIVAIDS. Most Transgender has a place with lower financial status and has low education level. It looks to have inappropriate medical services.

Illegal exploitation: Transgender has a place with the most ignored group. That’s why they are inclined to deal with the issue of illegal exploitation too.

Social Exclusion: The serious issue in the entire cycle is that they are socially prohibited from society. They are rejected from taking part in friendly, social, and financial life. To sum things up, they are avoided from –

  1. Economy, work, and vocation openings
  2. Avoided from society and family
  3. Absence of assurance from viciousness
  4. Confined admittance to schooling, medical services, and individual consideration
  5. Restricted admittance to public spaces
  6. Restricted admittance to collectivization
  7. Freedoms of Citizenship
  8. Avoided navigation
  9. Absence of federal retirement aide

ACKNOWLEDGED RIGHTS BY THE SUPREME COURT FOR LGBTQ

On 6th September 2018, the Supreme Court of India unanimously struck down a part of Section 377 of the Indian Penal Code, 1860 in Navtej Singh Johar and Ors. v. Union of India (2) which condemned sex against the nature request to avoid a wide range of grown-up consensual sexual conduct. Section 377 has been reprimanded for oppressing, and lopsidedly influencing, the LGBTQ people group, and for not being in line with current ethical quality.

In this judgment of the Supreme Court, the accentuation was on the basic right of gay people to live with respect, without the disgrace connected to their sexual direction, with equivalent pleasure in freedoms under India’s constitution, and equivalent assurance under the law.

The choice of SC on decriminalization of Section 377 depended on essential grounds under the Constitution – for example, on

  1. Right to equality under Article 14;
  2. Right against discrimination under Article 15;
  3. Right to freedom of speech and expression under Article 19; and
  4. Right to privacy under Article 21 (1).

• Right to Equality

Article 14 of the Constitution of India, even though permits that differentiation can be drawn, yet in addition commands that such a qualification should be founded on clear differentia. The Supreme Court held that there was no comprehensible differentia between individuals “who as far as anyone knows to participate in ‘normal’ intercourse and the people who take part in ‘bodily intercourse against the nature request”.

• Right against Discrimination

Article 15 of the Indian Constitution keeps the state from oppressing any resident just on the grounds of sex, religion, race, position, or spot of birth. In the Navtej Johar Case, Supreme Court held that any ground of segregation, regardless of whether immediate or aberrant, which is established on a specific comprehension of the job of the sex, comprises separation under Article 15. In this manner, Section 377 was held to be unfair under Article 15.

• Right to Freedom of Speech and Expression

Article 19 of the Indian Constitution manages the Protection of specific privileges in regards to the right to speak freely of discourse and articulation to all residents. In the Navtej Johar Case, Supreme Court noticed that Section 377 doesn’t qualify as a sensible limitation on a singular’s right to speak freely and articulation (3).

• Right to Privacy

Article 21 of the Indian Constitution peruses, “No individual will be denied of his life or individual freedom besides as per a system set up by law.” This article accommodates the security of life and individual freedom as a crucial right to all residents of India. The Supreme Court found Section 377 to abuse these protected freedoms as the right to security couldn’t profit from the LGBTQ people group individuals.

After the memorable verdict of the Supreme Court, India places itself in the rundown of those rights around 150 nations where gay action is lawful. The decriminalization of Section 377 by giving equivalent central freedoms to the LGBTQ people group as that of different residents was the initial move towards perceiving the privileges of the LGBTQ people group in India.

CONCLUSION

From the previously mentioned cases, we can express that our Indian Judiciary has been pushing forward in the accomplishment of the said expression steadily.   • Students must have a keen interest in Commercial Laws and the wide aspects of this field of Law.

Scheme of Internship

  • The internship is normally for a period of one month, commencing on the 1st working day of the month. However, applicants desirous of pursuing an Internship for 2-3 calendar months can also apply with due recommendation of the respective universities/Colleges/ Institution for the period applied for.
  • There will be a short induction program on provisions of Companies Act, 2013, Bankruptcy and Insolvency Laws, Research Methodology on the 1st day of Internship by the esteemed Director and Co-Director of CARCIL, CNLU, Patna.
  • The Internship will be in offline/online mode (as decided by CARCIL).
  • Selected Interns will be allotted specified research work pertaining to different areas of Commercial Laws.
  • Interns are expected to maintain discipline, punctuality, and integrity, non-compliance whereof shall result in termination of Internship.
  • The internship is a full-time program and hence interns are required to observe the working hours of the University.
  • The Internship may be discontinued any time if the performance of the intern is not found satisfactory or the intern is absent without authorization of concerned authorities of CARCIL.
  • Certificates will be issued to the interns on successful completion of their Internship.
  • This Internship is stipend free and hence, no honorarium will be granted to the Interns.
