The inaugural edition of the Courts and the Constitution Conference took place on 26-27 January 2019, with the theme â2018: Year in Reviewâ. It was a first-of-its-kind initiative in India and discussed the major legal developments and landmark judgments of the year 2018 in light of their long-term impact on the governance and rights of the Republic.
The second edition of the conference, âThe Republic at 70: Past, Present and Future Directionsâ was hosted on 25-26 January 2020. More than 25 legal luminaries participated in multiple panels on Developments in Equality Jurisprudence, Reforming Tribunals, Federalism and the Constitution, and Citizenship, Residency and the Constitution, as well as public guest lectures on capital punishment, among others.
The featured speakers in the past two editions included, inter alia, Arun Thiruvengadam, Sudhir Krishnaswamy, Arvind Narain, Chintan Chandrachud, Nizam Pasha, Suhrith Parthasarathy, Aparna Chandra, Anup Surendranath, Arundhati Katju, Alok Prasanna Kumar, Malavika Prasad, Harish Narsappa, Rohit De, Suchindran Bhaskaran, Ujwala Uppaluri, as well as N.R. Madhava Menon, M.P. Singh and Indira Jaisingh.
Both the editions were co-organized by the Editorial Team of the Law and Other Things Blog, NALSAR University of Law, Hyderabad, and the School of Policy and Governance, Azim Premji University, Bangalore, and took place in-person at NALSAR.
The third edition will be hosted on 26-27 March 2022, in a hybrid model (in-person as well as limited online streaming) in light of the extraordinary circumstances created due to the pandemic.
ââThe Courts and the Constitution â 2020 & 2021 in Reviewâ is scheduled for March 26-27, 2022. This conference is being co-organised by the Editorial Team of the Law and Other Things Blog, NALSAR University of Law, Hyderabad and Azim Premji University, Bangalore. In addition to the invited speakers, proposals for presentations by students, researchers and professionals who are below 30 years of age are invited. The proposals must relate to the themes that will be covered as part of the conference agenda.
About the Call for Proposals
This year, along with invited speakers for the various panels, interested students and professionals in the legal and associated fields are invited to submit proposals for presenting their papers during the conference.
If accepted, the applicant will get a chance to present their paper/ideas as a part of the panel, and proposals shall also be developed into papers that will be published by the Blog. The proposals should pertain to either of the six themes of the panels.

Eligibility
Proposals are invited from students and professionals from the legal field as well as allied disciplines. Since the objective of this Call for Proposals is to make the conference more accessible to a younger demographic, those who are under the age of 30 years will be given priority.
Structure and Rewards
The authors of the best entry corresponding with each theme will be selected to participate in the respective panels (allowing for virtual or in-person participation). Our aim is to have at least one speaker in each panel identified through this route. The selected authors will get the opportunity to present their work alongside established scholars and practitioners.
Please note that the proposals will be closely scrutinized and that the selection process is likely to be quite competitive. The conference organizers reserve the right to not select any entries, if they do not meet a certain qualitative threshold.
The participants may adopt any suitable means for presenting their work, including audio-visual aids or a PowerPoint presentation. The selected participants will have at least 15 minutes to make their respective presentations.
Criteria for Selection
The proposals shall be evaluated on the following grounds:
framing of the research question/s,
the choice of research methodology (if appropriate/relevant for the topic that is discussed),
treatment of the research question/s in the literature,
the framing of the central argument and the quality of substantiation of the chosen issues,
originality of the ideas/arguments presented, and
relevance of the chosen topic, in respect of the existing scholarship related to Indian Constitutional Law and the Indian Legal System.
Participation Guidelines
Co-authorship of entries (maximum two) among individuals from the same or different institutions is allowed.
Multiple entries by the same author(s) are not allowed.
Entries should be original, unpublished, and non-plagiarised.

The applicant is a PMSAMA Higher Secondary School Urdu teacher. He oversaw the NSS’s activities. On November 6, 2018, the victim, a minor child, and a student from a different school went to a camp at PMSAMA Higher Secondary School in Malappuram. The applicant is said to have complimented her on her accomplishments. He invited the victim to the principalâs chamber at 4 p.m. He took two pens from his drawer, one of which he gave to the sufferer. He then kissed her on the forehead after touching her hand. It was offensive to the victim since, according to her, it was done with sexual purpose. A complaint was filed on November 27, 2018, alleging these claims, which resulted in the subject offense being registered under Section 10 read with Section 9 of the Protection of Women from Sexual Offenses Act, 2012.
RELEVANT SECTION
Under Section 438 of the Code of Criminal Procedure, this case was filed under the Honâble court. Section 438 of CrPC talks about anticipatory bail regarding the commencement of doing some nonbailable offense. Anticipatory bail means that a person who is apprehending an interest can apply for bail in advance. The addition of this provision was a recommendation made by the 41st Law Commission of India.
ISSUES BEFORE THE COURT
Is the accused liable under Section 10 read with Section 9 of the Protection of Women from Sexual Offences Act, 2012?
Section 9 of the POCSO Act: Talks about Aggravated Sexual Assault Whoever conducts a sexual assault on a child while serving as a police officer: inside the confines of the police station or premises to which he is assigned; or (ii) within the confines of any station house, whether or not located within the police station to which he is assigned; or (iii) while performing his responsibilities or otherwise; or (iv) where he is identified or known as a police officer; or
(b) whomsoever commits sexual assault on a child while serving in the armed forces or security forces in jail, remand home, protection home, observation home, or other places of custody or care and protection established by or under any government authority; or whoever commits sexual assault on a child in a hospital, whether government or private; or whoever is on the staff of management of a jail, protection home, remand home, observation home or other place of custody or care and protection established by or under any government authority.
Hence, that a child is sexually assaulted by one or more members of a group in furtherance of their common goal, each of those members is deemed to have committed gang sexual assault within the meaning of this clause, and each of those members is liable for the act in the same way as if he had done it alone;
SECTION 10 of the POCSO Act: It talks about Punishment for aggravated Sexual Assault Anyone who commits serious sexual assault faces a sentence of imprisonment of either kind for a period of not less than five years but not more than seven years, as well as a monetary fine.
DECISION OF THE COURT
The High Court of Kerala held that the entire dispute between the respondent and the petitioner was settled amicably. The bench of Justice Alexander Thomas in the judgment wrote that the dispute was settled amicably and ordered that petitionerâs mother was required to submit an affidavit stating that she had no problem with the quashing of FIR.
SUPREME COURT ON THE DECISION
Justice M.R. Shah of the Supreme Court held in Laxmi Narayan that the High Court in that the case had not taken into account the relevant facts and circumstances of the case, particularly the seriousness of the offenses and their social impact while quashing the FIR as a result of the parties’ settlement, despite the fact that it was a non-compoundable offense. In that case, Justice Shah found that the High Court failed to assess the distinction between a personal or private wrong and a social wrong, as well as the societal impact.
During the hearing of the Kerala Government’s appeal against the ruling, the bench observed the government’s argument that quashing the FIR is not relevant in light of the Supreme Court’s decision in the case State of Madhya Pradesh vs. Laxmi Narayan & Ors (2019). Justice M.R. Shah of the Supreme Court held in Laxmi Narayan that the High Court in that the case had not taken into account the relevant facts and circumstances of the case, particularly the seriousness of the offenses and their social impact while quashing the FIR as a result of the parties’ settlement, despite the fact that it was a non-compoundable offense. The International Tribunal for the Law of the Sea (ITLOS) is an independent judicial body established by the United Nations Convention on the Law of the Sea to adjudicate disputes arising out of the interpretation and application of the Convention.
The Tribunal is composed of 21 independent members, elected from among persons enjoying the highest reputation for fairness and integrity and of recognized competence in the field of the law of the sea.
The Tribunal has jurisdiction over any dispute concerning the interpretation or application of the Convention, and over all matters specifically provided for in any other agreement which confers jurisdiction on the Tribunal (Statute, article 21).
The Tribunal is open to States Parties to the Convention (i.e. States and international organisations which are parties to the Convention). About the Internship Opportunity
The Tribunal (ITLOS) offers a limited number of internships (20) each year to students and recent graduates of law, international relations, public relations, political science, library science and translation.
Interns work under the supervision of Registry officials on matters relevant to the Tribunalâs work. The 3-month programme allows students to gain an understanding of the way in which the Tribunal functions and to participate in the work of the Registry.
Interns are expected to be able to contribute to the work of the Tribunal in fields such as the law of the sea, public international law, international organizations and international relations, political science, public information, library science and translation.
Tasks at the Legal Office
Legal Office
The Legal Office consists of 4 legal officers, working under the supervision of the Head of the Legal Office. The Legal Office works in close cooperation with the Registrar,
conducting research on international law, law of the sea and administrative legal matters;
examining legal instruments and precedents relating to the work of the Tribunal;
drafting judicial reports on questions relating to the work of the Tribunal;
serving the meetings of the Tribunal and preparing background material, reports and papers; and
providing legal advice on a diverse range of substantive and procedural questions of law as well as on the management and administration of the Registry.
Tasks involved:
Interns work under the close supervision of one of the legal officers. They carry out research on a variety of legal issues and prepare notes for their supervisor, the other legal officers, or the Registrar.
Interns are also requested to conduct research on a specific topic of their own choice, upon which they prepare a written paper and give an oral presentation to the Legal Office at the end of the internship.
Together with other interns serving at the Tribunal, they also prepare the weekly press review covering recent developments in the law of the sea.

Applicants should:
have completed at least 3 years of university studies;
normally be engaged in a degree-granting or postgraduate course at the time of application and also during their internship, or be a recent graduate;
normally not be more than 35 years of age;
have a good command of English and/or French; and
have an interest in international law, in particular international law of the sea, international affairs or international institutions and organizations.
ITLOS interns are students or recent graduates from all over the world, all sharing an interest in international law and in particular the law of the sea. Their backgrounds are varied and depend on the department they are attached to: those in the Legal Office have usually completed their first law degree or are already working on a masters in international law or a PhD in a law of the sea-related topic.
In the selection of candidates, due consideration is given to geographical diversity and gender balance.
Availability of Funding
A Trust Fund for the Law of the Sea was established in 2010 with the aim of providing financial assistance to participants from developing countries. A limited amount of funding is available to assist interns with their living and travel costs.
In addition to the requirements for participation in the programme, the following criteria apply in determining eligibility for internship funding:
Applicants must be nationals of a developing country included on the OECD list and should normally be resident in that country; and
Applicants should be in need of financial assistance to help cover the travel and living costs associated with an internship in Hamburg.
Candidates should indicate their interest in applying for funding in the online application form. Late applications for funding will not be considered.

If you are interested in participating in the internship programme at the Tribunal in Hamburg you should submit:
A covering letter no more than one page in length, explaining why an internship at the Tribunal is important to you, how it would fit in with your academic and career goals, and what benefits you expect to derive from the programme;
A brief sample of research work in English or French of no more than 10 pages, if possible on a topic of relevance to the work of the Tribunal;
Copies of a document as proof of your enrolment in a university course, your university degrees/diplomas and a list of courses taken or grade transcript;

The Team winning the final round of the Competition shall be given:
