Brief Facts and Procedural History

The appellant was a Superintendent in the Chief Engineer’s office who was charged under Section 379 of IPC. He was accused of removing a file from the Chief Engineer’s office to deliver it to a friend (co-accused). The co-accused substituted certain documents and returned the file the next day.

Later, upon being threatened by the Chief Engineer, he gave a confession that was later retracted. The petitioner challenged the order of the Hon’ble court that convicted the accused, but set aside the charges against the co-accused.

Issues before the Court

Whether Section 24 of the Indian Evidence Act can be interpreted in order to extend its scope?
Whether the act of taking something out of the possession of a person and returning it later would constitute as ‘theft’ under Section 379 of IPC?

Ratio of the Case

The hon’ble court concluded that theft can be temporary as well as permanent in nature. The court expanded the scope of the definition of theft as mentioned in the existing acts by stating that temporary or permanent unlawful possession of any movable property that causes material or immaterial wrongful loss shall be considered as theft.

The scope of opinion in matters of induced or coerced confessions under S. 24 of Evidence Act was expanded to introduce flexibility in deciding upon such matters.

Decision of the Court

The court chose a different path to adjudge the matter by laying down points of distinction over the conclusion of facts. The court believed that the officer was working in the capacity of an officer and not officer-in-charge. Thus, he cannot be held to be the one in legal possession of the file.

Besides, the definition nowhere expresses that the dispossession must be permanent in nature in order to constitute theft and hence the bench held that the conditions pre-requisite for the crime of theft are fulfilled in the present case. The Hon’ble judges further disregarded the arguments of the petitioner thereby holding that wrongful loss can constitute ‘the loss of any property that is lost by an unlawful means to which the person at loss is legally entitled to’.

An enthusiast in the field of human rights, Sanya Darakhshan Kishwar is currently an Assistant Lecturer at the Jindal Global Law School, O.P. Jindal Global University, Sonipat, Haryana, India. She holds a Masters in General Laws (LL.M.) from the Pennsylvania State University, U.S.A. and an Integrated Bachelors in Law and Science (B.Sc. LL.B. (H)) from Central
University of South Bihar, India. She has passed her LL.M. in International Human Rights Law from the University of Leeds, U.K., with Distinction. She was the recipient of the Best Law Student of India Award in 2018. She received the SILF-MILAT full tuition scholarship towards
the completion of her LL.M. from Penn State Law and the Liberty Scholarship towards her tuition fee at the University of Leeds. At Penn State, Sanya was a part of the team that won the 26th Williem C. Vis International Commercial Arbitration Moot in Vienna. She also worked as a
Research Assistant under the tutelage of Prof. Catherine Rogers assisting her on the project Arbitrator Intelligence. She has keen interest in the field of gender justice and has been a member of the Gender Sensitization and Equal Opportunity Cell in her undergraduate years. Her dissertation at Leeds highlighted the inadequacy of the existing international framework in addressing the increase in rates of child marriages in areas affected by armed conflicts. She received Distinction in her dissertation.

GUJARAT MARITIME UNIVERSITY:

Gujarat Maritime University (GMU), an endeavor by Gujarat Maritime Board (GMB), the state regulator for the ports and maritime activities in Gujarat. INTERNATIONAL CONFERENCE ON MARITIME LABOUR LAW:

Maritime workers perform an admirable service to humanity by helping in moving ships and a variety of cargo from one port to the other. Working on long-term contracts, at sea, and far away from home, seafarers have to face numerous challenges. These include issues related to repatriation, abandonment, non-payment of wages, etc. Mindful of problems faced by seafarers in international waters, some forward-looking developments have taken place in international law. Today there are numerous Conventions and recommendations on working conditions in the maritime transport sector. The purpose of these is to achieve decent work for seafarers and to secure economic interests through fair competition for quality ship owners.

The body of the manuscript must be in “Times New Roman” font only. font size 12, line spacing 1.5 and alignment “justify”. The paper has to be original and free from plagiarism. The word limit for Draft Papers is 4000-6000 words.

All footnotes must be in Font “Times New Roman”, font size 10, line spacing. All submissions must follow the “The Bluebook: A Uniform System of Citation (20th Edition)”.

About Our Organization:

Law, Psychology and Philosophy Review is a student run academic initiative with the aim of bringing in together the cultures, ideas, opinions and thoughts from other fields of study to create awareness about the importance of interpreting law from different perspectives beyond the

You will be working under the Academy of Banking and Financial Affairs for the duration of your internship. You will be required to research on Banking Law and Finance Law. You will have the opportunity to interact with field experts in the field of Banking and Finance Laws and further get a chance to enhance your training and consultation skills in this domain.

ELIGIBILITY CRITERIA:

Students who are currently enrolled in the 3-year and 5-year UG Law course and willing to work for one month.

TENURE:

One Month starting from 5 April 2021 to 7 May 2021

About the Journal:

Journal for research in law is an E – journal by Anumaarga. Call for Submissions:

Contributions are welcome from academicians, legal professionals, and research students in the field.
The journal will be accepting full-length research and scholarly articles, and legislative/case comments documenting original and substantial research work.
The research work may have a doctrinal or empirical approach.

Theme:

Submissions are invited on any topic of contemporary relevance in the area of Law, but the papers on abstract ideas will be given preference.

Categories and Word Limit:

Submissions may be in the form of the following categories:

Articles: Papers that comprehensively analyses a theme and engage with all the existing literature in it. An article should be in between 3000 to 5000 words Inclusive of footnotes.
Essays: Papers that concisely analyses specific contemporary issues in the field of law.
It should be between 2000 and 3000 words inclusive of footnotes.

Submission procedure:

All submissions are to be made through email only. Submissions are to be emailed at editorialboard.Anumaarga@gmail.com. The receipt of submission shall be acknowledged within 24 hours.
The paper should contain an abstract in the beginning of not less than 300 words clearly indicating the idea of your Article/paper/essay.
Five keywords are to be provided along with the abstract.
Following the abstract should be the title page containing the paper’s title and the authors’ details including the author’s contact details. In the case of co-authorship, details of both the authors are to be given.
The rest of the manuscript should not contain any author-identifying information.

Formatting and editorial guidelines:

All submissions must be sent as a Microsoft Word document.
Please use Times New Roman, font size 12 with 1.5 line spacing for the main body of your piece (except the title). Footnotes must use Times New Roman, font size 10; alignment justified for the entire piece.
Footnoting can be done in any uniform method of citation (Bluebook, MLA, SILC, NUJS Law Review, ILI, etc.)
All non-English terms and Latin legal phrases need to be italicized.
Please avoid underlining or bolding phrases and sentences for emphasis (except for subheading and title).
Double quotations must be used only when directly quoting a statement, in other cases, use single quotes. All direct quotes must be referenced for context.
Acronyms or short forms (especially non-standard) must be written out in brackete accompanied by their full form.
All submissions need to be referenced, especially facts and case laws must not be stranded loosely. Articles with aforesaid irregularity can be sent back despite their potential.
Needless to say, plagiarized work will be outrightly refused.

Note: Articles can be resent to the author for rectification and clarification if additional information is required.

Deadline:

The last date for submission is 31th March 2021. Submissions sent after the deadline will not be considered for publication.
Publication certificate will be given to the Authors of Selected Papers or Articles.
