About the Organizers

Dr. Vishwanath Karad MIT WPU is the Flagship University of MAEER’s MIT Group of institutes, which has over 100,000 alumni all over the world. MIT WPU Campus is in Kothrud, Pune, and is the most preferred destination for students.

School of Law was established in the year 2018 and with the launch of this School, a new chapter began at MIT WPU. About the Competition

MIT-WPU Faculty of Law cordially invites your college to participate in CCI – MIT WPU School of Law 2nd National Moot Court Competition 2022. Which is going to be held from April 28th to 30th, 2022. This competition intends to allow young law students to develop their skills in drafting, researching and advocating.

The objective of this moot court competition is to test the research skills of students in contemporary topics in the sphere of competition law and provide a platform where students can learn about competition from industry experts.  

Eligibility

The moot is open to all the students currently enrolled in LLB undergraduate degree courses. The competition has been designed for all the students pursuing law courses at different Universities/Institutes/Colleges approved by the Bar Council of India. 

Students pursuing the five-year integrated law degree as well as students pursuing the 3-year law degree are eligible for participation in this competition.

About the Organizers

The Government Law College, established in 1855, is the oldest in Asia, a pioneer in legal education – an institution par excellence. The generations of legal luminaries who have been nurtured by this unique institution have made a seminal contribution to the evolution of the Indian Legal System.

The Chamber of Tax Consultants (CTC) Mumbai is a non-profit organization established in 1926. The organization was formed to serve the object of educating and creating awareness among its members in Direct Tax, Indirect Tax, Allied Laws, Corporate Laws, International Tax, etc.

Eligibility

All students of any recognized law college in the country can participate.

Team Composition: Each team shall comprise three students- two speakers and one researcher.

Format of the Moot Competition

  • A maximum of 16 teams shall participate, and the registrations shall be accepted on a first-come-first-serve basis.
  • The competition will be conducted in a hybrid model.
  • The Prelim and Quarter Final rounds will be held online on June 5, 2022, and the Semifinals and Finals will be held offline on June 18, 2022, in Mumbai.
  • The said Rounds shall be judged by members of the tax fraternity, Hon’ble Members of the ITAT, and the Hon’ble Judges of the High Court.
  • There shall be prizes for the Winning Team, Runner up Team, Best Speaker, Runner up Speaker, and Best Memorial.

The Moot Problem

This year, the Moot Proposition shall be based on Income Tax Act, 1961.

About the Conference

Intellectual property rights refer to the privileges given to the inventor, creator, or an organization to protect their innovation for their exclusive use rights for a certain period. Their Importance arises from the encouragement and the financial aid to stimulate creativity in the field of modern sciences and technology. Several amendments were made to the Intellectual Property Rights Laws considering the impact of socio-economic and technological developments.

However, despite these amendments, there has been a consistent increase in violations of IPR in the form of music piracy, software piracy, linking, caching, framing, digital databases and plagiarism, etc., and these violations adversely affect the economy.

Additionally, counterfeiting of trademarks in cyberspace and cybersquatting is increasing day by day, and without stringent provisions, these issues will not be resolved. Trade secret or undisclosed information protection is one of the challenges companies or businesses face in the absence of concrete legal provisions.

Further, the Patent Amendment Act 2005 introduced process and product patents in food, chemical, and pharmaceutics; however, there is a need to balance conflicting claims of access to medicine and exclusive right over patents in compulsory licenses.

This peculiar imbalance has resulted in a reluctance to grant compulsory licenses, evident from fewer licenses permitted even in medical emergencies. IPR has environmental implications as well.

Patent Law has always been criticized for environmental pollution, greenhouse effects, and climate change, and there is an urgent need to revisit the provisions in the light of sustainable development. Growing unauthorized commercial use of traditional knowledge makes indigenous communities more vulnerable, and in the absence of comprehensive law at the international level, it isn’t easy to protect these resources.

Further, biotechnological inventions and their impact on the environment need to be reviewed, considering Laws on Climate Change and Biodiversity.

Effective enforcement of Intellectual Property Rights can be understood by analyzing the intersection of IPR with other Laws. There is always debate and controversies between IPR and other laws. Such asIPR provides exclusive rights and recognizes the monopoly, and on the other hand, Competition Law prevents monopoly. These are just some of the issues prevailing in the IPR regime. These issues need academic discussion and deliberations.

Therefore, MMSCLC’s Intellectual Property Rights Cell considered it necessary to have a brainstorming discussion regarding various problems prevailing in Intellectual Property Rights and to find solutions to deal with them in these changing times.

About the Asian Parliamentary Competition

The organizing committee Samvaad, a student-governed committee, was established with intrinsic
value of the Ancient Indian Philosophy of Vadashastra- वा देवा देजा यतेतत्वबो ध: meaning “Truth is discovered and assimilated or realized by debates and discussions,” in 2020.

Samvaad aims to facilitate an inclusive and accessible platform for the new generation of aspiring lawyers by encouraging them to think wisely, talk valiantly, and debate logically; with such values and determination, the committee is organizing its First Edition of National Parliamentary Debate-Asian Style.

The debate rounds would be held in four stages two (2) Preliminary rounds, followed by
Quarter-Finals, Semi-Finals, and The Grand Finale.

Format of Debate

Each debating match will consist of two teams; one to propose the motion and one to oppose it. The
the team proposing may be known as ‘The Proposition,’ ‘The Affirmative,’ or ‘The Government.’

The team opposing may be known as ‘The Opposition’ or ‘The Negative’. Teams will be designated as the
Proposition or the Opposition for each round of the competition.

  • There shall be no circumstance whatsoever that a team consisting of more than 3 members be allowed to participate. No observer/ additional member can be part of a team in any capacity.
  • There shall be no substitution of any team member after a team has submitted its Registration Form, except with the permission of the Organizers.

Rules

  • From each college, 2 candidates can participate as a team for the motion and against the motion.
  • Candidates will not be permitted any identifying uniform.
  • Paper reading is not allowed.
  • Language is no bar.
  • Each candidate would be provided 5 minutes to speak, and an alarming bell after 4 minutes would be rung.
  • Candidates should avoid disputable aspects while debating.
  • The decision of the judges would be final.
  • Each candidate would be given a participation certificate.
  • The teams from each college shall be allotted a team code; revealing of the identity of the student and college shall amount to direct disqualification of the team.

About the Journal

NLUA Law Review is one of the flagship journals of National Law University and Judicial Academy, Assam. It is an Annual Peer-reviewed Journal focusing on inter-disciplinary and multi-disciplinary approaches towards legal writing. The Journal is run by a Student Editorial Board and assisted by a Faculty Editorial Board.

The Journal aims to publish articles, case comments, book reviews on all aspects of Law and related issues. Here special emphasis is placed on contemporary legal studies along with its foundational philosophical thoughts.

Eligibility

The Editorial Committee of NLUA Law Review is inviting quality Research Papers from

  • Academicians and professionals (inter/multi-disciplinary with Law);
  • Judges and Advocates;
  • Research Scholars, and
  • Students (if the Editorial Board deems it fit to be an extraordinary work of scholarly merit).

What can you submit?

Research Papers should be thematic, and identification of sub-themes will be highly appreciated. It should have proper research questions and should also reflect the findings. The submission can be sent under the following categories:

1. Research Articles: (5000 – 7000 Words) Authors have to submit research papers that comprehensively examine the topic. It should reflect an innovative re-assessment of the theme. It is advisable, though not necessary, to choose a theme that is of contemporary importance. Purely theoretical-analytical pieces are also welcome.

2. Notes/Comments: (2500 – 5000 Words) This section should include a thought-provoking and innovative piece consisting chiefly of personal opinions, analysis or criticism on recent development from the legal perspective.

3. Case/Report Comments: (Maximum 2500 Words) This part should entail an analysis of recent Indian or International judicial pronouncements relevant to the themes. It must identify and examine the line of cases in which the decision in question came about, and comment on implications for the evolution of that branch of Law.

4. Book Review: (1000 – 1500 Words) The Reviewer should identify the relevant arguments put forth by the author and present a comprehensive analysis of the same. The hard copy of the book must be provided.

Submission Guidelines

  1. Submissions should be in Georgia, 12 fonts with 1.5 line spacing, justified text and 1-inch margins on all sides of an A4 sheet.
  2. Footnotes should be in Georgia, 10-font size with 1.0 line spacing.
  3. Endnotes and/or Bibliography and in-text citations are not allowed.
  4. Graphics, Charts, Tables, and Diagrams should be numbered consecutively and included in the body of the work.
  5. Headings should follow the following standard:
    • Title of the submission: Upper-case, bold, font size 14
    • Headings: Upper-case, bold, font size
    • Sub-Headings: Title-case, bold, font size 12
    • Sub-Sub-Heading: Title-case, italics, font size 12
  6. Submissions must contain an Abstract (250-300 words) that outlines the main questions or themes addressed in the paper, followed by five keywords.
  7. The submission must be the original work of the author and must not have been submitted elsewhere or pending review.
  8. Co-authorship is allowed. The maximum number of co-authors for a submission shall only be one.
  9. Mode of citation will be OSCOLA (Oxford University Standard for the Citation of Legal Authorities), the latest edition.

The manuscript should be accompanied by the author’s name, designation, name of institute, contact number and e-mail for future reference and correspondence.

About the Moot Court Competition

The CMR National Moot Court Competition, the flagship event at CMR University, School of Legal Studies is a biennial event that witnesses participation by premier legal institutions in the country. This competition attempts to facilitate the development of interpretation and legal reasoning skills in the participating students, with a benign hope of encouraging them to achieve greater heights. The previous edition of the same was held virtually in the year 2020.

The current edition shall be restricted to a total participation by not more than 20 teams competing in two preliminary rounds to be judged by experienced advocates, professionals and law teachers from Bangalore.

Each semi- final round shall be judged by a bench of 3 senior advocates and the final round shall be presided by a bench of 5 sitting judges from the High Court of Karnataka.

This moot, as any other, expects to present important questions of law that are challenging yet accessible and inviting; and enable participants to present the best of themselves -as aspiring practitioners of law and as ladies/gentlemen with integrity, wisdom, and eloquence.

Eligibility

Participation is strictly restricted to bona fide law students enrolled in the 3-year or 5-year LL.B. degree course in any institution in India.

Participating Teams shall duly fill and submit the registration form on or before May 6, 2022, 11:59 PM.

The Teams must upload the payment details on the abovementioned form.
