The School of IPR and Commercial laws is an autonomous research school of the Research Board of All India Legal Forum. It is an initiative to promote interdisciplinary research in corporate law and related fields like competition law, policymaking, conflict management, banking and Intellectual Property Rights. The main objective of the school is to provide holistic advice on all issues relating to corporate affairs and Intellectual Property Rights, and impacting on corporate functioning, including the legislative, policy, structural, governance, regulation and interdisciplinary/ coordination issues, keeping in view the current developments and the probable future scenarios.

OBJECTIVE:

The main objectives of the school of IPR and Commercial Laws are as follows:

● To set up and advance connections internationally and nationally with similar bodies, and provide a focal point in India for researchers in corporate law.

● To attempt and encourage research on corporate laws and entice students of the highest potential to provide opportunities for their engagement in corporate law research projects.

● To establish close relations with top associations and members of the legal profession associated with corporate law and securities regulation.

● To research Corporate Laws and allied laws of foreign countries and to identify training and development needs of the officials of the legal, regulatory other agencies associated with the implementation of corporate laws, rules and guidelines.

● To provide a forum for critical research on the interplay of contemporary issues in corporate law, both from an academic and industry perspective.

● To provide insight into how Intellectual Property Laws are essential.

● To provide a forum for discussion and debate in the field of Intellectual Property Laws to students and academicians, and to undertake academic research and study to suggest improvements in various laws, bills and government policies.

● To provide high quality and exclusive legal research both doctrinal and empirical by nature in the field of IPR and Commercial Laws.

ROLE:

You will be working under the The School of IPR and Commercial Law for the duration of your internship. You will be required to attend webinars and sessions and participate in debates and quizzes. You will further be required to give presentations and write research papers within the jurisdiction of commercial law.

Introduction:

A recent judgment of the Bombay High Court has taken social media by storm, with netizens raging over the regressive outlook of the court. The case, Satish v State of Maharashtra, revolved around the fact that a 12-year girl was assaulted and groped, yet the Bombay High Court held that “in the absence of any specific detail as to whether the top was removed or whether he inserted his hand inside top and pressed her breast, would not fall in the definition of ‘sexual assault.” This ruling came even after precedents from various other High Courts (in the case of Jagar Singh v State of Himachal Pradesh), including the Bombay High Court ruling that Sexual Assault under Section 7 of POCSO Act, need not be skin to skin, and even the act of touching a minor with sexual intent in their private area would attract the penalty under Section 7.

Section 7 and the outrage

This case saw the relevancy of the POCSO being put into question. It has been stated that skin-to-skin touch is necessary for constituting an offence under Section 7 of the POCSO Act. In the present scenario, groping of child’s breast has not been considered an offence under Section 7.
Section 7 constitutes that, touching of vagina, breasts or any such private area with “sexual intent” is punishable. However, in this case a new concept of skin-to-skin touch has emerged.
It is also to be noted that, the offence has been held punishable under Section 354 of the Indian Penal Code, that is, outraging the modesty of a woman. However, questions are now being raised as to whether it is correct to negate the entire spirit of the POCSO Act.
Questions such as, if the POCSO Act was enacted to safeguard the rights of children specifically, why is the act is not being relied upon in such situations? Section 7 of POCSO provides for rigorous punishment and gives preference to the rights of children. However, keeping reliance on IPC is making this act non-reliable for such cases. Both IPC and POCSO have their own validities and importance. Overlapping of the laws in ways that degrade the other shall not be fruitful for anyone.
Due to extreme public outrage, and the above mentioned valid arguments the Supreme Court on Sunday stayed the Bombay High Court’s order.

Conclusion/Personal Views:

It is important to create a threat in the minds of criminals to make the laws stringent. The relevancy of the laws has to be maintained by the courts, rather than dragging other laws in between. Section 6 and 7 of POCSO are alone relevant and compatible of punishing offenders in scenarios like the present one. It will be awaited to see the further decision of the Supreme Court because the decision here will make a huge difference for future references. This provision is about the safety of children, it cannot be neglected the way it has been done, in this judgement.

Introduction

There has been a huge debate on the power of arrest of the police. The debate highlights various important points on grounds of which the arrest by police has been justified in some situations while opposed in some. The cases that have been registered till now related to this controversy have also come out with different views and opinions. The case of Sachin Saini v. State of Up and 2 others revolves around the granting of anticipatory bail to the applicant. The petition highlights some of the crucial points including the contentions of both the applicant and the respondents.
Facts: The FIR lodged in the present case is regarded as a counter to the FIR lodged by the complainant. According to the complainant, an FIR was lodged against him by his father on 24.08.2020. The charges that were put on him were as under section 147, 148, 323, 504, 506 of I.P.C. the main ground that was taken in the FIR was that the complainant has not committed the above-mentioned crimes and the allegations against him are false. The grant of anticipatory bail has been put forward by the counsel of the applicant with the support of various grounds.

Issues Raised:
  1. Whether the allegations put by the complainant’s father on him are true or not?
  2. Whether the complainant is eligible for the grant of interim bail?
Provisions included:

The FIR that was filed against the applicant by his father was filed based on the charges as under:
Section 147 I.P.C.- the offense of rioting and punishment
Section 148 I.P.C.- the offense of rioting armed with a deadly weapon and punishment for the same
Section 323 I.P.C.- Punishment for voluntarily causing hurt
Section 504 I.P.C.- intentional insults that lead to provocation of a person so that he breaks public peace
Section 506 I.P.C.- Punishment for criminal intimidation
The provisions are all from the same code.

Submissions by the applicant:

The learned counsel of the applicant has submitted that the allegations put on the applicant are not true and the applicant is being falsely defamed. Also, the council puts forward a time that the applicant is not having any criminal history. The reason for the filing of the application for anticipatory bail is because the applicant is of apprehension that he might get arrested on basis of the FIR filed by his father against him.

Submission by the opposition:

Learned counsel on behalf of the opposition party has submitted that the allegations that have been laid on the applicant are not minor. The offenses are of a serious nature and anticipatory bail in such cases cannot be granted to retain the validation of law. also, the apprehension of the applicant is not present on any paperwork and no record is present for the same. Based on imaginary apprehension, bail cannot be granted to the applicant.

Court’s order-

After the consideration of the submissions made by the counsels of both the parties, the Court opined that there was a case registered against the applicant by his father.
Some cases were cited by the court while passing the order. In the case of Joginder Kumar v. State of Uttar Pradesh, the third report of the National Police Commission was referred by the apex court. The report stated that the main cause of corruption in the country was the arrests by police. It was contended that nearly 60% of the cases are unreasonable and are sometimes unnecessary too. The unjustified actions of the police accounted for an increase in the expenditure in the jails. Also, such arrests are against human rights as discriminatory arrests are not in accordance with fundamental rights.
The court, at last, passed the order for the release of the application based on anticipatory bail. The applicant was said to be involved in the aforesaid crimes and several conditions were to be followed by the applicant. The conditions involved that the applicant could not leave the country without prior permission, the application had to surrender his passport, cannot misuse the liberty granted via bail, presence of the applicant in the trial court when called. The verification of the documents of the applicant was required so that the applicant does not take any step that goes against the rules and regulations.

Significance:

The judgment is significant in understanding that the provision of anticipatory bail can be used by people so that unnecessary arrests can be avoided. This will also lead to a decrease in corruption amongst authorities. The order given by the court states that the person was under some obligations. Such obligations are also important because they bind a person which prevents him from committing any crime in future instances. Such orders are of importance to prove that courts are also going against the arrests and if a reasonable cause is present, anticipatory bails can be granted by the court to preserve some of the human rights.

The new chairperson appointed by the BCCC, Broadcasting Content Complaints Council, is Justice Gita Mittal who also happens to be the first woman to serve as a Judge and Acting Chief Justice of the Delhi High Court, and later, in August 2018, she the Chief Justice of the Jammu and Kashmir High Court.

Justice Mittal succeeds former Supreme Court Judge, Justice Vikramajit Sen, whose tenure as BCCC chairperson has ended.

IBF set up an independent self-regulatory body called BCCC in June 2011 to examine content-related complaints relating to all non-news general entertainment channels in India. BCCC consists of 13 members, and it is in its 10th year of operation and has addressed 96,000 and more content related complaints. Former Chief Justice of Madras and Delhi High Courts and former Chairperson of Law Commission of India, Justice A P Shah, was the founding Chairperson of BCCC. 

Justice Gita Mittal is a former student of Lady Irwin School, New Delhi, and has completed her higher education from Lady Shri Ram College for Women. She further persuaded her law degree from the Faculty of Law, Delhi University. Her career of legal and judicial dates back to 1981. 

Justice Gita Mittal after being appointed said that “I look forward to joining BCCC in its unique journey of self-regulation, which also promises to be an exciting and challenging one.”

  • One month (25th Feb, 2021- 25th March, 2021).

No Stipend

Tasks & Instructions:

  • You have to send us 3 articles/research papers and 1 case comment unplagiarized ones during the tenure of internship.
  • Interns who will be sending us unplagiarized assigned work within time will be receiving certificate of completition.
