The Centre of Excellence for Environment and Forest Laws of ICFAI Law School, IFHE Hyderabad, has been founded with the objective of creating awareness about the environment degradation and protection; to ingrain the future generations with the idea of environmental protection and to train the students in a clinical way by creating a Club where they conduct the activities for the protection and upgradation of the environment.

The name of the Environmental Law Club is Green Ambassadors Inspiring All (GAIA). GAIA Club has been student-centric since its inception has the participation from all the batches of BBA.LLB (H) and BA.LLB (H) is being supervised by faculty coordinators. It is regulated under the aegis of the Centre of Excellence.

About the Competition

This event is for students of Law across India. National Competitions have been organized by the Environmental Law Club, Green Ambassadors Inspiring All (GAIA) on the occasion of International Water & Forest Day, i.e. 20 March, 2022.

The Club has initiated the brainstorming on the water crisis by organizing a symposium titled “Water Resources: Sustainable Overtures”, which was graced by eminent persons from the field of law, judiciary, NGO’s and various government departments.

The Centre of Excellence for Environment and Forest Laws along with GAIA has been receiving the MOEFCC, Government of India, sponsored training program projects to impart training to the Senior Indian Forest Service Officers nominated by MOEFCC from different parts of the States since 2018 and have successfully completed three such training programs on various topics viz, Environment protection and forest conservation, Joint Forest Management: Issues and Challenges and Intellectual Property Rights: Forest and Trade.

Introduction

Over time, many changes occur in society; these changes have both beneficial and harmful consequences. As the nature of law evolves, new laws and amendments are introduced into society to regulate the violation of living beings’ rights, privacy, and security.

There’s a Bible proverb that goes something like this: “Either you can believe all of it or you can’t trust any of it,” and that’s how fake news spreads. If you can’t distinguish which news is real vs phony, which is truth vs lies, many people will quickly throw up their hands and declare that none of them can be trusted.

With the introduction of computers, the internet, social media, and networking websites, these developments, particularly on the technological front, became mass development with the introduction of computers, the internet, social media, and networking websites, which crept into and made their way into people’s lives.1

The law of social changes as trends change. People are discovering new ways to conduct crimes in a high-tech manner as time progresses. However, by adopting new statutes and enactments, the law has broadened its jurisdiction and begun to remove these flaws from society. As a result, the Government of India has submitted a bill called the Fake News (Prohibition) Bill, 2019.

Fake News Prohibition Bill, 2019

The Fake News (Prohibition) Bill of 2019 was passed to make it illegal to create and distribute fake news in the media, as well as other related issues. In India, fake news refers to misinformation or disinformation conveyed by word of mouth and conventional media, as well as more recently through digital modes of communication such as altered videos, memes, unconfirmed adverts, and rumors circulated on social media. This statute applies to the entire country of India, it includes:

a) Misquotation of one’s remark is an example of fake news.
b) Altering audio and video files, causing facts and context to be distorted.
c) For the advantage of a person, agency, or entity.

Objectives of the Bill

Fake news has made it easier to spread false information in the era of the internet, where anybody can submit a report or a comment that appears to be a news item and declare it to be accurate and factual. Fake news or information must display or intend to exhibit propaganda to blacken or disgrace one’s reputation or create or plan to induce fear, division, turmoil, violence, or hate. Due to the propagation of fake news on social media platforms such as Whatsapp, Facebook, and Twitter, a huge number of mob lynching occurrences have been recorded around the country. Political parties were also discovered to be distributing misinformation on social media during the country’s elections, according to studies.

To control and the spread of fake news in any form, whether it is through circulation, sharing, misquotation of statements, editing of audio and video clips, fabricating content, undermining, sowing seeds of enmity, sedition, hatred, disseminate, edit, abet, etc., a debate took place in the House of Lok Sabha on the subject on February 8, 2019, and Shri. Tej Pratap Singh from Mainpuri proposed before the Hon’ble Chairperson to introduce The Indian media research organization CMS indicated in a report by The Guardian that the growth of false news was due to India’s “lack of (a) media strategy for verification.” Additionally, reporters and journalists have been imprisoned for “making false stories, “particularly when the pieces were contentious.

Fake News in India

In Alakh Alok Srivastava v. Union of India2, the Supreme Court of India acknowledged the problem of infodemics in India and issued an order for state governments to follow the Centre’s orders to combat the threat of fake news. The top court also highlighted the necessity for the government of India to provide a daily bulletin through all media outlets as a source of real-time verifiable information on Covid-19 to alleviate the fear and apprehension generated by the uncontrolled flow of fake news.

The recent mass evacuation of migrant workers was caused, according to this petition, by the anxiety induced in the minds of the laborers as a result of bogus news that inflated the duration of the lockdown to endure for more than three months. Poor migrant laborers were killed as a result of this evacuation, which was brought about by the distribution of illicit information.

Fake news spread over WhatsApp in Odisha, claiming that a person from outside the state had been sick. After an inquiry, the police discovered that the claim was untrue. At the time, India lacks a specialized law to control false news; yet the epidemic is demonstrating the necessity for one.

Provisions of different laws in India

Information Technology Act, 2008 (IT Act)
In India, social media platforms that are classified as ‘intermediaries’ under Section 79(2)(c) of the Information Technology Act, 2008 are obligated to exercise due diligence when performing their tasks. Initially, under the Act and the April 2011 guidelines, intermediaries were not liable if they were not responsible for the origination, transmission, or reception of such content across their reach. As a result of this change, intermediaries gained protection, allowing them to be slackers in their efforts to combat bogus news.

When the government realized its error, it devised a remedy on the opposite extreme of the spectrum, instructing intermediaries to proactively block information. These restrictions have been compared to censorship in China. The government can use this as a political weapon to suppress stuff that does not benefit them. The free expression would be harmed by such a law.

Indian Penal Code (IPC)3
Section 505(1)(b) of the IPC deals with the dissemination of false and malicious material that causes fear or panic in the general public, or in any segment of the general public, with the intent of inducing an individual to commit an offense against the state or public peace. The offender under this section can be punished with imprisonment of a maximum of 6 years and a fine. Section 505(1)(b) combined with Section 54 of the DMA have been envisaged to include the expansion of fake news to a large extent.

The actual issue with fake news is fraudulent information that is disguised as real news in the form of unpaid pieces. The malice requirement might be avoided, and the spreader of misleading information could face severe responsibility and exemplary damages. The implementation of strict responsibility, on the other hand, would need tracking the disinformation back to its source, which has been recognized as a time-consuming and inefficient procedure.

Disaster Management Act, 2005 (DMA)4
Section 54 of the DMA professes to handle ‘false alarm or warning as to disaster or its severity or magnitude, leading to panic’ and this has been applied while recording arrests so far. It makes the offense punishable with imprisonment up to 1 year and the imposition of a fine. The same provision, on the other hand, has long been criticized for being too narrowly focused on catastrophes at a time when the breadth of false news is far broader.

While this one-of-a-kind characteristic of the Act restricts its use to disasters, it does have a good side effect. It ensures that the use of this clause does not extend beyond the extraordinary circumstances of a disaster, preventing the government from using it to further restrict free expression.

Curbing Fake News within Jurisprudence

Restriction of some rights can be permissible in the context of major public health hazards and public emergencies endangering the nation’s survival, according to international human rights law. The size and severity of the Covid-19 epidemic have elevated it to the status of public health danger, justifying limits on freedom of expression and speech. Such limits, however, must adhere to the standards of international human rights law. The same has been enshrined under Article 19(3) of the International Covenant on Civil and Political Rights (ICCPR)5 which requires the limitations to have a legal basis, to be solely significant, to be subject to review, and to be proportionate to acquire the aim. While it is vital to take steps to prevent the spread of disinformation, there is an unintended consequence. Efforts to combat false news might result in the imposition of censorship laws or the suppression of critical thinking that is essential to make educated judgments. To combat the spread of disinformation, Thailand’s government recently enacted restrictions that included a blanket prohibition on communications that are either “false” or “misleading”. The Thai government used this method to detain an artist who challenged the government’s reaction to the current public health crisis.

Concluding Observations

During this situation, it is critical to combat bogus news. It should not, however, come at the price of free expression. Temporary measures that take away some liberties in the near term but do not turn out to be a political weapon for any ruling administration are the way ahead in suppressing free expression. Temporary measures will allow the government to make necessary modifications to the current system to safeguard us. We should allow the government to protect us in our weak state, but this should not result in the government abusing our frailty. To combat the rapid spread of fake news, the government must collaborate with the public and intermediaries. We must do so; else, fake news may prove to be as deadly as the epidemic. Without a question, the problem of fake news and fake is growing like wildfire around the globe, necessitating the passage of legislation to regulate and restrict the transmission of fake news on social media and other platforms. The bill was constructed and prepared with the goal of prohibiting the transmission and distribution of false news, and thus “The Fake News (Prohibition) Bill, 2019” was created and presented to the Lok Sabha.

Selection Process

Duration of internship

  1. WWF-India internships positions open twice a year – in February and October
  2. Internships are normally for a period of 30 days to a maximum of 6 months.
  3. Persons interested in working with WWF-India for less than 30 days may apply under volunteer’s programme.

Stipend

WWF-India will not pay a stipend to students who are pursuing the internship as part of their completion of studies (academic courses).

However, others interested in an internship with WWF-India may be paid a stipend based on their experience.

Academic Credits/Certificate

  1. WWF-India cannot grant academic credits for an internship. Only the University can grant this.
  2. WWF-India may assist the student, by providing relevant information requested by the academic department.
  3. Certificates will be issued to interns, on satisfactory completion of their internship assignment and submission of their outputs.

Modalities

  1. Interns are required to give an undertaking prior to joining the internship programme.
  2. The interns will be issued a daily visitor card for the duration of Internship.
  3. Interns will be taken through respective divisional brief overview within a week of joining the internship.
  4. Each intern will be assigned a Guide.
  5. Interns will be provided with required logistic support based on their assignment.
  6. An intern, who is a foreign national, will be constrained not to visit any sensitive (Protected and Restricted) area for work.

Submission of Papers/Reports

  1. The interns will be required to submit an output (Presentation, Report, Paper, and Data) on the work at the end of the internship.
  2. Interns will also be required to give feedback on their internship experience.

General Rules

  • Each team should consist of a minimum of 2 and maximum of 3 members. This number cannot be modified under any circumstances.
  • There shall be 2 speakers and 1 researcher designated for each team. The researcher shall be allowed to argue with prior permission of the court and National Administrator in case of illness of the designated speakers.
  • Each team will be provided a team code prior to the submission of memorials via e- mail.
  • This team code is only for the memorials. Teams should not disclose the identity of their institution in their memorials; such disclosure shall invite penalties including disqualification.
  • The decision for the same shall be at the discretion of the National Administrator.

The guest speaker for this webinar will be Advocate Vikram Srivastava who is a human rights advocate and the founder of Independent Thought. The NGO has been working for child rights and for furthering women’s rights in the country. It was after the case of Independent Thought v. Union of India (2017] 10 SCC 800, AIR 2017 SC 4904), that even marital sexual intercourse with a girl below the age of 18 was declared as a criminal offence. Currently, the NGO is fighting to get marital rape criminalised in India. The webinar will be addressing the issue of marital rape in India and aims to raise awareness, equip students with credible facts and impart much needed sensitization. 

The webinar will be held on 15th February, 2022 at 1600 hrs. The platform will be Google Meet and the link will be shared with the registered participants.

Theme

Submissions that deal with any aspect of marital rape will be considered. The participants are free to explore other related fields as well.

Eligibility for Kanooniyat Opinion Writing Competition:

  • Students (UG/ PG/ Certifications/ Diploma) from any stream from any University/ College/ Institute in India.
  • Multiple entries from one participant are not permitted.
  • Co-authorship (Team of 2) is permitted.

Awards and Perks:

  • Winner: Rs. 1500 + Certificate of Merit.
  • Runners up: Rs. 1000 + Certificate of Merit.
  • Top 5 entries: Certificate of Appreciation.
  • Exciting internship opportunities to the top five entries. The internship opportunity for the winners and runners up will be under the aegis of Advocate Vikram Srivastava and for the remaining top entries, the same will be provided for by LawInternships (The Online Law School).

Submission Guidelines:

  • The Opinion Writing must be written solely by the registered candidate(s) (co-authorship upto two is allowed), in English, and should not have been submitted for publication elsewhere.
  • The minimum word limit for Opinion Writing is 900 words. There is no maximum word limit.
  • All submissions have to be made in MS Word format and should be typed in Times New Roman, font size 12 and 1.5 line spacing.
  • The page margins should be 1” or 2.54 cm on all sides.
  • All text should be aligned as justified.
  • All claims of the author(s), in the body of the manuscript, are expected to be backed by reasons along with proper citations and shall not be mere assertions.
  • Any violation of rules shall result in direct disqualification.
  • The submissions will be scrutinised through plagiarism software. Permissible limit of plagiarism is 20%.

Copyright of the Submissions:

  1. All the Opinion Writing drafts submitted shall be the exclusive property of the organizers.
  2. The organizers shall be free to use the information/ views therein in any manner they require and deem fit.
  3. The decision of organizers in deciding the winner(s) shall be final and binding and no query, correspondence, etc. in this regard shall be entertained by the organizers.

Note:

  1. Opinion Writing draft submissions incompatible with the above rules and submission guidelines will not be considered for evaluation.
  2. The submission of entries to the competition implies acceptance of the above terms and conditions by the participant(s).
  3. Kanooniyat reserves the right to cancel the event at any point before the conduct of the event. In such a case, any fee paid as registration fee shall be refunded in full to the registered participants.

Registration and Submission Procedure:

  1. Participants are required to register for the Opinion Writing Competition by paying the registration fee. Click here to pay fees
  2. Once the registration fee is paid, participants have to take a screenshot of the same and fill the registration form.
  1. After they fill the registration form, participants will receive an email acknowledging the same from our end which will also have the submission link for the Opinion Writing Competition. The registration shall be complete after this step. 
  2. Participants will have to submit their drafts using the submission form before the deadline. 
  3. The participants are required to submit their documents by 11:59 PM, 21st February, 2022, after which the submission form will not accept entries.

Registration Fee:

The participants are required to register for Kanooniyat’s Opinion Writing Competition by paying the registration fee of Rs. 250 (single author) or Rs. 400 (co-authors), through the payment link provided, before the registration deadline, i.e., 15th February, 2022 at 2 PM. The same will enable the participants to attend the webinar.

The Amity Law School, Noida is an institution established by an educational society RBEF (Ritnand Balved Education Foundation) with the object of providing high-quality education in the legal domain. The Founder of Trustee, an NRI, and an industrialist, and the president of RBEF, Dr Ashok K Chauhan is a renowned philanthropist who has dedicated his life to the service of the nation through education. About Student Bar Forum

The Moot Court Society of Amity Law School, Noida was established in 2010 by the reckoning of our Founder President Dr Ashok K. Chauhan and under the able guidance of Additional Director Late Prof. Mamta Srivastava and the immense contribution of our faculty members.

However, in the year 2015, the society has been restructured as the ‘Students Bar Forum, Amity Law School, Noida’ under the auspices of our Additional Director, Mentor, and Faculty Incharge Mr Tushar Ved Saxena.

The Students Bar Forum is a student committee entrusted with the responsibility of administering mooting activities, ADR Tournaments, and Client Counseling Competitions upholding the high standards of excellence that Amity Law School Noida has set itself.

The role of the Students Bar Forum is to facilitate and regulate mooting, ADR tournaments, and client counselling competitions, at Amity Law School, Noida.

About the Event

This Competition is conceived to promote & develop skills about the procedure followed by Courts and test the knowledge of the law students across the nation. It tests the law students both on the aspects of knowledge of law and facts. This is an effort of providing such a platform to law students so they can learn the basics of trial Court which in turn opens a wider gate of one’s overall learning experience.

Most law school trial advocacy courses focus on tactical skills, though some integrate basic methods of strategic planning. Some academics have expressed disfavor with advanced strategic techniques because of the imbalance they create, especially against attorneys who are unaware of them. Proponents of advanced strategic techniques argue that these methods are the only effective means to counter the already-existing imbalances in the system, as between indigent defendants and the state, and between working-class plaintiffs and well-resourced, wealthy corporations.

As one of the impending graduate schools in India, we are continually taking measures to give comprehensive and significant lawful schooling to brilliant youthful ability from across the country. In the course of such undertakings, we have seen that solid backing abilities, capacity to think sensibly and judiciously, joined with discernment for drafting, are a few key qualities that are essential for a legal advisor in the current situation.

AMUCM Law Society Review is the flagship journal of Aligarh Muslim University Centre Murshidabad, started with the objective of promoting academic research and proselytizing debate on contemporary legal issues.   • Submissions of the Abstract must be made to the above-mentioned email ID, with the subject line “Abstract Submission for AMUCM Law Society Review 2022.” And before 11:59 PM, 28th February 2022.The word limit for the Abstract is 250 words. The abstract must indicate key findings on a topic. 
  • No biographical information or references, including the name(s) of the author(s), affiliation(s), and acknowledgments should be included in the abstract submission. 
  • A separate cover letter in (.doc) or (.docx) format containing particulars of the author(s) and the submission details is to be sent along with the submission.
  • Submissions of Manuscript must be submitted to the above-mentioned email ID, with the subject line “Manuscript Submission for AMUCM Law Society Review 2022.” and before 11:59 PM, 30th  March 2022.
  • Similarly, the document containing the cover letter shall be named in the manner ‘Cover letter_ Title of the submission’.
  • A cover letter shall include: (1) Title of Submission; (2) Abstract; (3) Name of the Author and Co-Author, if any; (4) Designation; (5) Institutional Affiliation; (6) Contact Information and Address for Correspondence.
  • Scholastic uses only footnotes (and not endnotes) as a mode of citation. Submissions must conform to the ILI mode of Citation style. Do not include any pictures or other illustrations in the submission. All the submissions have to be in English. 
  • A mail confirming the abstract of the manuscript and subsequently its acceptance for publication would be duly conveyed to the author/s through the email id used by the author(s) for correspondence.
  • The submission of the author(s) shall be accepted for publication on the condition that they do not infringe on the copyright or any other rights of any third parties. Author(s) shall be responsible for infringement of any law. All submissions will undergo strict online plagiarism check.
  • Special consideration will be placed upon originality, applicability and feasibility of the arguments/ suggestions made in the manuscript the depth of research. 
  • Submission of a manuscript shall be taken to imply that it is an unpublished work and is not being considered for publication elsewhere.

You shall take the help of enacted laws/Acts/Rules/ commentaries, SC/HC landmark judgments, government websites, new updates on the concerned law/future development or amendments in the Act expected from the government.

Referencing: The source of the information must be mentioned. The source should be genuine and the link should be attached.
