About the Journal

Journal of Law and Legal Studies is an online bi-annual journal with a summer and winter edition. The Journal emphasizes creating an open-access platform to research around Socio-legal topics and promote interdisciplinary research entailing detailed study of law with other disciplines in the contemporary era.

Eligibility

All academicians, Research Scholars, Lawyers, and Law Students can submit original manuscripts of Articles, Book reviews, Case Comments, and Legislative Comments relating to a recent development in Law and Legal Studies.

Types of Submissions Accepted

The Journal of Law and Legal Studies invites original, unpublished manuscripts from all academicians, authors, legal professionals, and Law students in the following categories:

  1. Long Articles: 4000-7000 words, Excluding footnotes
  2. Essays/Short Articles: 2000-4000 words, Excluding footnotes
  3. Case Notes and Legislative Comments: 1200-2500 words

General Instructions

  • Long articles and short articles must be accompanied by an abstract not exceeding 200 words.
  • Up to two authors are allowed for all categories, except Case Notes and Legislative Comments wherein co-authorship is not permitted.
  •  All citations should conform to the Bluebook 20th Edition or ILI citation style and shall be placed in foot-notes. 
  • All works must be original and unpublished, and must not be pending for review before any other journal. 
  • Any form of plagiarism will result in immediate disqualification.
  • While it is advisable to adhere to the word limits of each category, the journal may be flexible on the word limit depending on the quality of the article.

  1. The manuscript in Word format (.doc or .docx) as an attachment. PDF/other formats/hard copy submissions will not be accepted.
  2. The body of the first page must mention:
    1. Name of the author(s)

Formatting Guidelines

  • The first page of the manuscript should contain the name of the paper, name of the authors and their institutional affiliation followed by a 200-word abstract
  • The second page should commence with the main body of the manuscript.
  • The name of the authors and their institutional affiliation must be mentioned in the manuscript.
  • Texts and footnotes should conform to the ILI citation style.
  • The main body of the manuscript should be in Times New Roman style, font size 12, with 1.5 line spacing and footnotes in Times New Roman Style, Size 10, with 1.0 line spacing. 
  • All headings must have uniform formatting.

General Rules of PN Mathur National Moot Court Competition

  • The PN Mathur National Moot Court Competition is open to all bona fide regular students enrolled in any undergraduate law course or its equivalent in any University or Institute within or outside India recognized by the Bar Council or State Government or Central Government as the case may be.
  • Each team shall comprise three members i.e. two speakers and one researcher. A team may also be comprised of two members i.e. two speakers only. The composition of the team shall not be changed once a team has registered under any circumstances whatsoever.
  • The members of the team must be designated as either ‘Speaker’ or ‘Researcher’ and such designation shall be conveyed to the Administrators at the time of registration. No researcher under any circumstances shall be allowed to present any arguments during the Oral Rounds.
  • Changes in the aforementioned designations shall not be made without a request by the responsible Faculty in Charge or Head of the Institution or Department of the Team seeking such change, as the case may be.
  • The discretion to allow or disallow such change shall solely rest with the administrators depending upon the reasonability of the cause shown, stage of the Competition, and compliance with the aforementioned rules.
  • No additional member or team coach besides the three or two members, as the case may be, shall be recognized as a participant and be allowed to attend the Oral Rounds.
  • Due to the pandemic, the organizers are unsure whether the event will be offline or online. If the situation allows it will be organized offline otherwise it will be conducted online.
  • Note: In the case of online mode, your additional accommodation fees will be refunded to your respective bank accounts.

INTRODUCTION

An E-contract is also known as a digital contract that is written and signed electronically. A contract agreement between two or more parties that is legally enforceable. Commercial contracts with e-businesses can be exchanged with the use of e-contracts. An e-contract can be created on a computer and emailed to a business counsel. The digital signature of the business advocate specifies that he accepts the contract. An electronic contract is an agreement between two parties for the sale or supply of digital items and services. On an electronic contract, traditional ink signatures are not feasible; instead, a computer executes and enacts them in electronic form. The main aim of e-contracts is to negotiate and draft successful contracts for business purposes.

ESSENTIAL ELEMENTS OF ONLINE CONTRACT

  • Offer– The offer should be made by one party to another and should have a lawful purpose.
  • Acceptance– When the person to whom the offer was made accepts it, it becomes a promise.
  • Intention to create a legal relationship A contract that does not establish a legal relationship is not a legitimate contract; a contract that does not establish a legal relationship is not valid.
  • Lawful object– Parties entering into a contract should do so with a legal purpose in mind. To be legally enforceable, a contract must be made for a legal purpose.
  • Lawful consideration Consideration is one of the most important features of any contract. The basic concept of consideration is that if a party to a contract keeps his word, he will receive something in return. The form of consideration has to benefit, right, or profit.
  • The capacity of Parties– Parties who enter into a contract must be capable of doing so. It is necessary to be of sound mind and to have reached the age of majority.
  • Consent– Consent should be unrestricted, and the parties’ minds should meet. Consent must be genuine and unrestricted, and it cannot be obtained through deception, misrepresentation, or undue influence.
  • The Contract’s terms and conditions must be specific and not ambiguous.

E-CONTRACTS RECOGNITION

The Validity of E-contracts is emphasized in Section 10 of the Information Technology Act. To be valid, a contract must include the offeror offering for the proposal another person accepting the proposal, denial of the proposal, and acceptance, as valid, stated in electronic form via electronic channels. Such contracts cannot be declared void because electronic forms were working or for that purpose.

  • When electronic records are recognized and official to a contract when the electronic contract has been presented, conveyed, and acceptance has been received then Information Technology Act recognizes E-contracts as legal.
  • A Digital Signature Certificate is likewise legally legitimate and enforceable, according to the IT Act.
  • Indian Evidence Act of 1872- According to the Indian Evidence Act of 1872, a contract is legitimate if it contains any information in the form of an electronic record written on paper, stored and recorded in an optical created by computer.

EVIDENTIARY VALUE UNDER THE INDIAN EVIDENCE ACT

Electronic papers are recognized by Indian courts. The Indian Evidence Act of 1872, Section 65-A. The process for presenting evidence of electronic documents is governed by section 65-B of the Indian Evidence Act, 1872. Section 65B of the Indian Evidence Act states that any information that is contained in electronic records which are printed on paper, or a copy of that record which is created on magnetic media, is considered to be secondary evidence document if it meets the conditions in section 65B.

  • Section 85A– The assumption of electronic agreements includes this part. It says that once a digital signature is attached to an electronic record that represents the nature of an agreement, the document is regarded as finished. To ensure that e-contracts are authentic, Section 85A was enacted. The assumed value, however, has many limits. The presumption only applies to electronic recordings, electronic records older than five years, and electro records.
  • Section 85B– In the lack of evidence to the divergent, Section 85B provides that the court must assume that the record in question has not been tampered with in any way. The secure status of a record can be requested for a specific amount of time. 
  • Section 88B Any electronic message carried by the maker over an electronic media to the addressee to whom the message is to be sent is assumed to have been loaded into the computer for transmission.
  • Section 90A The court may assume that a digital signature was used to attest to the agreement’s legality if an electronic record is 5 years old and in proper care. A digital signature can be added to a document by anyone who has been permitted to do so. An exception can be made if the facts of a given instance indicate that the origin is likely.
  • Section 85 C– The court will assume that the information contained in a digital signature certificate is correct and true. The phrase “must suppose” relates to the court’s discretionary jurisdiction being expressly excluded.
  • Section 65B specifies that any information contained in an electronic record that is printed on paper and generated by a computer is considered a document.

In a country with a low literacy rate, such as India, the concept of ‘Digital India’ remains a long way off. People are still wary of making online purchases since the terms and conditions of such agreements are unclear. The type of law that governs electronic contracts is also vital to examine. Even though the Information Technology Act of 2000 legalized electronic contracts, it lacks particular rules. As a result, in terms of evidentiary value, we can claim that those electronic contracts are comparable to hard copy contracts. Because electronic contracts are legalized by the Information Technology Act, they are all valid contracts, and anyone who interrupts the terms and conditions may be held liable. Since then, many changes have been made in an attempt to gain conceptual clarity. The evidentiary value of an electronic record is determined by its quality. 

CASE LAWS

TRIMEX INTERNATIONALA FZE LTD. DUBAI VS VEDANTA ALUMINIUM LTD.

In this example, the parties communicated their offer and subsequent acceptance via email. The Supreme Court of India recognized the legitimacy of an electronic transaction and declared that if a contract is reached, a formal contract signed and initialled by the parties will not influence the contract’s implementation.

ARJUN PANDIT RAO VS KAILASH KUSHANRAO(JULY 2020)

The Supreme Court has ruled that when one enters into an electronic document as evidence, it is required compliance with Section 65B of the Indian Evidence Act. The certificate filed underneath this clause contains information on the electronic records as well as the identification and authorized signature of the person with official responsibility for the management and operation of the relevant device.

CONCLUSION

It can be concluded that electronic contracts are as similar as hard copy contracts if we consider the evidentiary value of the contract. All e-contracts are valid contracts as they are governed by the Information Technology Act and can be made liable if there arises a case of infringement with the terms and conditions

About CCI

Competition Commission of India (CCI) has been established under the provisions of the Competition Act, 2002 (Act). Its objectives are to eliminate practices having an adverse effect on competition, promote and sustain competition in markets, protect the interests of consumers and ensure freedom of trade in markets in India. The Act also mandates the Commission to undertake advocacy i.e. to create awareness and impart training on competition issues.

As a part of its advocacy initiatives, CCI announces the organisation of an ‘Online quiz on Competition Law’ to be held on the MyGov platform from November 15 to 30, 2021. The objective of the Commission is to create broad-based awareness of Competition Law in India and generate interest in the nuances of the law among the stakeholders.

The event will be held as a part of the ‘Azadi ka Amrit Mahotsav’, which is an initiative of the Government of India to celebrate and commemorate 75 years of progressive India and the glorious history of its people, culture and achievements.

Residents of India (aged 18 years and above as on October 31, 2021). Individuals working in CCI or O/o Director General (permanent and contractual), and their immediate family members are not eligible to participate in the Quiz. The Government of Rajasthan in consultation with the Chief Justice of the High Court, framed the Rajasthan State Legal Services Authority Rules, 1995, and this Authority also framed the Rajasthan State Legal Services Authority Regulations, 1999 to give effect to the provision of the Legal Services Authority Act, 1987( Act No.39 of 1987).

About Project 39A

Project 39 A is a formal part of NLU Delhi that is inspired by Article 39A of the Constitution of India, a provision that furthers the intertwined values of equal justice and equal opportunity by removing economic and social barriers.

They are engaged in providing pro bono legal assistance to prisoners sentenced to death across the country by using empirical research to re-examine practices and policies in the criminal justice system.

Project 39A aims to trigger new conversations on legal aid, torture, forensics, mental health in prisons, and the death penalty.

About the Internship

Project 39A is developing a robust and rewarding internship program that will provide meaningful exposure to the complexities and nuances of the criminal justice system in India.

Work Undertaken

The different kinds of work undertaken are:

  • Research: Our research efforts lay significant emphasis on fieldwork and empirical analysis. Efforts involve work on various aspects of the following issues:
    • forensic science with a particular focus on DNA forensics
    • legal aid in the criminal justice system
    • mental health and criminal justice
    • torture
    • administration of the death penalty
  • Litigation: To ensure competent pro bono legal representation for prisoners sentenced to death in various parts of India, irrespective of the crime;

Qualifications

Open to students in India and other countries, enrolled in a recognized undergraduate or post-graduate program in the

  • law,
  • humanities,
  • social sciences,
  • management or
  • media and communications.

Those enrolled in other programs may apply but preference will be given to those enrolled in the programs listed above.

Roles and Responsibilities

Candidates will be asked to undertake tasks that may involve assisting with litigation activities, research projects, or initiatives in public outreach.

While the organization shall attempt to account for the interests expressed by the interns, it reserves the right to allocate tasks as it deems fit as per its requirements.

All members of Project 39A undertake administrative duties and therefore interns will also be expected to assist in administrative matters.

Interns will be required to observe the working hours of Project 39A and work from its offices only.

Duration

Internships are full-time and for a period of minimum 4 weeks to a maximum of 12 weeks.

Candidates must indicate the exact dates in their application.

Work Location

Interns shall be based out of NLUD’s offices on the NLU Delhi campus in Sector14, Dwarka, New Delhi 100078.

Application

While applications for part-time interns are considered, there is a strong preference in favor of full-time
interns.

Part-time interns, if selected, are required to intern for a minimum of 12 weeks.

Salary

  • Stipend of Rs 10,000/- (Rupees Ten Thousand Only) for every four-week period of internship undergone.
  • Interns on a part-time internship will be paid a stipend of Rs. 5,000/- (Rupees Five Thousand Only) for every four-week period of internship undergone.
