LEXSTRUCTOR NATIONAL JOURNAL OF LAW & TECHNOLOGY calls for ORIGINAL and UNPUBLISHED Research Papers, Short Articles and  Case Comments for its upcoming Volume 1 Issue 2, February 2021.

Theme

We are interested in receiving submissions on any contemporary issues in the law as well as its interrelation with the technology, e.g., but not limited to e-commerce, cybercrime, biotechnology, competition, intellectual property and  any current social-legal issues. 

Submission Guidelines

1. Submission should be made in MS Word format.
2. The manuscript shall be original and unpublished.
3. The manuscript shall be free from plagiarism, any spelling mistakes and grammatical errors. 
4. Co-authorship is allowed to maximum three authors.
5. The full names, designations, contact numbers and email addresses of all the author(s), must be mentioned only in the cover page of the manuscript. 
6. There shall be a uniform method for citation (BLUEBOOK 20^TH EDITION) in the manuscript. 
7. The body of the manuscript shall be in Times New Roman, font size 12, 1.5 line spacing. Footnotes should be in Times New Roman and size 10, with single line spacing.
8. Tabular columns, diagrams, or any photograph with proper sources are allowed to use in the Manuscript. Photographs and diagrams must be of 1200px x 675px or less than that.
9. A margin of 1 inch shall be maintained from all sides. 
10. Manuscript texts should be justified and the headings should be either left-aligned or centre-aligned. 
11. An abstract of not exceeding 250 words (along with five keywords preferred) must be accompanied with the manuscript.
12. Manuscript file must be named as < ‘Title of the Manuscript_First Name of the author(s)’>. Except in the cover page, name or details of the author(s) should not be mentioned anywhere in the Manuscript.
13. On submission of the manuscript, the authors will receive acknowledgement of the receipt of their submissions via mail. Every submission shall undergo through three stages’ review process. The authors will be updated on completion of each stage of review. On qualifying three-stages of review, the qualified submissions shall be selected for publication.
14. On selection of the manuscript, the author(s) will be informed about the same and accordingly, authors are required to fill up ‘copyright statement’ provided in the website and pay the requisite minimal fee for publication on the journal i.e.

15. After completion of all the required formalities, the authors are required to email us the transaction details along with the payment receipts. Post-publication, every author will be received certificate of publication via email.

Brief Facts and Procedural History

In 1960, S. Natarajan was Assistant Secretary in the Department of Industries and Cooperation of the Government of Madras. At that time he with his wife and two daughters was living in Nungambakkam. Rama was the oldest daughter, Savitri was the youngest daughter. Rama at that time was studying in the Madras Medical College; Savitri was a student of the second year B.Sc. Class at Ethiraj College.

While living there, Savitri the youngest daughter of S. Natarajan became friendly with a neighbour named Varadarajan who was residing in the house next door of S. Natarajan. They both Starting talking with each other. On 30th September 1960 at 9:00 am, Rama saw both Savitri and Varadarajan talking to each other; she had also seen them talking to each other previously many times. So, Rama asked Savitri why she was talking to Varadarajan, Savitri in return told her that she wanted to marry Varadarajan. On the Same Day, Rama told her Father (S. Natarajan) about Savitri and Varadarajan when he returned home around 11:00 am. When S. Natarajan went to ask Savitri about it, she started crying, but did not say anything. So on the same day, S. Natarajan took Savitri to Kodambakkam to live with his relative (K. Natarajan) with the thought of keeping Savitri far away from Varadarajan for some time.

On 1st October 1960, Savitri left the house of K. Natarajan around 10:00 am and telephoned Varadarajan, to meet her at a particular road in that area and, she walked to that place. When she reached there, Varadarajan had already arrived in his car. Savitri got into the car and then both she and Varadarajan went to the house of P.T. Sami at Mylapore intending to make him the witness of their marriage at the Registrar’s office. They picked up P.T.Sami and then they went shopping at Govindarajulu Naidu on Netaji Subhash Chandra Bose Road where Varadarajan purchased two genders and Tirumangalyam which were selected by Savitri and then they went to the Registrar’s office. There they registered their marriage and, as witness P.T.Sami and P. K. Mar, a person who was co-accused before the Presidency Magistrate, but was acquitted by him signed the document. After registering their marriage, both Varadarajan and Savitri went to Ajanta Hotel and stayed there for a day. Varadarajan purchased some Sarees and blouse for Savitri and, on the next day, they went to Sattur by train.

On 4th October 1960, they went to Sirukulam and lived there for 10 to 12 days and then went to Coimbatore and then to Tanjore. In Tanjore, they got found by the police who were investigating the kidnapping case of Savitri on the Complaint made by S. Natarajan.

They both returned to Madras on 3rd November 1960.

The case went to Madras High court; there the court convicted Varadarajan guilty for kidnapping and awarded One-year Rigorous Punishment to him. Then Varadarajan appealed against the judgement given by the High Court of Madras in Supreme Court. He appealed by special leave. The Supreme Court Acquitted the Appellant (Varadarajan) from the sentence passed by Madras High Court.

Issues before the Court

• Whether a minor can abandon the Guardianship of his or her guardian?
• Whether taking out of lawful Guardianship has been established or not?

Ratio of the Case

The court observed the following things:

• Savitri admitted that on 1st October 1960 she left the house of K. Natarajan and telephoned Varadarajan to meet her at a particular place. From the words said by Savitri, we can see that Varadarajan did not suggest Savitri leave the house of K. Natarajan and nor did Savitri left the house at the instance.
• Savitri had stated that she wanted to marry the appellant. Varadarajan had not forced Savitri to go to Registrar’s office and to marry him. 
• The insistence of marriage came from Savitri and not from Varadarajan. 
• The fact that Savitri accompanying the appellant all along is consistent with Savitri’s own desire to be the wife of the appellant in which the desire of accompanying him wherever he went was implicit.

The Court observed that the appellant was not guilty of taking away Savitri out of the keeping of her father. Savitri voluntarily accompanied Varadarajan and, the law does not cast a duty on Varadarajan of taking Savitri back to her father’s house or even of telling her not to accompany him.

Savitri was not a child of tender years that she cannot think for herself. She was on the verge of attaining majority. Savitri was capable of knowing what is good and bad for her. Savitri was an educated girl as she was a senior college student and, she has been living in the city probably all her life. So she was capable of thinking for herself and acting on her own than an unlettered girl who lived her whole life in a rural area. 

No offence under Section 361 has been established as the appellant has not taken Savitri out of the Guardianship of her father. She voluntarily left.

Decision of the Court

The Court held that no offence under S. 363 has been established against the appellant and therefore he is acquitted.

Also, the Sentence and conviction passed upon him was set aside.

The High Court has observed that all satellite TV channels telecast advertisements that contain nudity for promoting condom sales that are ruining young mind. Such advertisements are intentionally breaking the Cable Television Network Rules, 1994 and the Cable Television Network Act, 1995. The HC said that such content affects younger minds. The court had ordered to remove the “vulgar” teaser of movie ‘Irandam Kuththu’ from all the social media platforms.

High Court has observed that some condom advertisements, telecast by satellite TV channels, look like porn films that is spoiling younger minds. The court said such advertisements portray women in a manner that violates norms of decency established by various laws.

The court made this decision after hearing a PIL, filed by KS Sagadevaraja seeking directions to the Centre and the state government to take action against cable operators and TV channels for airing “vulgar” and “obscene” content.

‘Vulgar’ ads violate laws

After 10 pm almost all TV satellite channels, telecast some ads which contain nudity for promoting the sale of condoms for the profit.

The court temporary order to restrain the satellite channels to telecast content with vulgarity and obscenity, and sough response on programmes’ censorship as prescribed under the Cinematography Act, 1952.

HC ordered removal of ‘Irandam Kuththu’ teaser 

The court had ordered to remove the teaser of film ‘Irandam Kuththu’ from social media platforms on November 11. The court had observed that the teaser exhibited obscenity that would corrupt the minds of youngsters, which, in turn, would result in an increase of crimes against women and minors.

All India Legal Forum is a team of more than 800 law students across the country to tackle basic problems which a legal researcher faces in day to day life. POST:

Intern – Social media Team, Graphic Board of All India Legal Forum 

ROLE:

You will be working under the Graphic Board of All India Legal Forum in the social media team for the duration of your internship. The role primarily entails: 

• Handling and managing the social media handles of All India Legal Forum.
• Ensure timely posting on social media. 

ELIGIBILITY CRITERIA:

• Students who are currently enrolled in the 3-year and 5-year UG Law course and willing to work for two months.

NO. OF VACANCIES:

TENURE:

Two months

PERKS:

• A Certificate of appreciation will be given every month based on performance to the selected top performers.
• Certificate of completion will be given upon successful completion of the tenure of two months. 
• Special perks will be given (if possible)

STIPEND:

There is no stipend involved.
