Introduction

India has accomplished a great deal since independence, and one of its biggest successes is its ability to develop its satellites, launch systems, and ground control technology for commercially launching not just Indian but also foreign satellites. ISRO now holds a monopoly on Indian space activities with the help of various industries, both private and public, providing services on a large scale. ISRO now employs over 17,000 people, and its yearly budget has increased to INR 100000 million (almost US$1.3 billion) from INR 60000 million five years ago1. Just like other industries, the legal industry helped in regulating laws related to outer space. The Constitution of India, 1950, the Satellite Communications Policy, 2000, and the updated Remote Sensing Data Policy, 2011 are the sole legislative frameworks that control India’s space sector.

Legislations Governing Space

Over the last 50 years, the ISRO has been at the forefront of pushing this industry, providing a variety of services ranging from navigation and communications to images, and facilitating a variety of social and economic activities. Although ISRO is considered to be the only governing body, India also has some policies regulating different issues under Space Law which are as follows:

  • Satellite Communication Policy, 19972
    The Satellite Communication Policy of 1997 has as its goals the development of a satellite communications service business as well as the continued use and development of India’s capabilities in the areas of satellites, ground equipment design, and launch vehicles The issued guidelines and norms clarified the policy’s scope and emphasized the use and development of the INSAT network, as well as giving Indian satellites performing other critical functions preferential treatment to promote telecommunications, broadcasting, and meteorological services in India.
  • Remote Sensing Data Policy, 20113
    According to the 2011 RSDP, satellite remote sensing data with a resolution of up to 1m can be obtained by obtaining a license from the DOS, but any request for satellite remote sensing data with a resolution of greater than 1m requires special clearance from the High-Resolution Image Clearance Committee (HIC) due to national security concerns. For the procurement of high-resolution photographs, the Indian government department is exempt from obtaining HIC approval.
  • Technology Transfer Policy
    It is a well-defined and methodical policy for the transfer of know-how of technologies and products generated by Indian Space Centres to Indian companies, as well as their commercial use concerning various space initiatives. To achieve significant industrial participation, it provides services relevant to space systems, such as communications, broadcasting, geospatial information, and manufacturing satellites and their components. It also allows for the licensing of technological know-how from various ISRO centers; as a result, about 300 technologies have been transferred to domestic companies too far.
  • Indian National Space Promotion and Authorisation Centre (IN-SPACe)4
    The Indian National Space Promotion and Authorisation Centre (IN-SPACe) was authorized by the Union Cabinet on June 4, 2020, to offer a fair playing field for private market firms to exploit Indian space infrastructure. It intends to give the private sector a much-needed boost by assisting, advising, and encouraging private industry engagement in space operations through a rigorous and favorable regulatory system. Greater access to ISRO infrastructure, satellite data, facilities, scientific and technological resources, and other space assets would promote the socio-economic utilization of India’s space resources and expand space-based activities.

Significance of Indian Space Laws

In terms of launching prowess, India’s transition from reliance to self-sufficiency might make it the world’s launch pad. Other governments and multinational corporations have entered into official agreements with India to help them in their different space initiatives and launch satellites for them due to India’s cost-effective space programs. As a result of the introduction of commercialization, domestic laws such as contract, transfer of property, stamp tax, registration, insurance, and, most crucially, intellectual property rights must be revised to account for space-related difficulties. India is currently going slowly toward enacting accurate space legislation. The Space Activities Bill 2017 has been developed and is currently awaiting Parliamentary approval. By permitting commercial and non-governmental organizations to participate in space exploration, this measure would encourage, support, and regulate space operations in India.5

A manufacturing flaw in a spacecraft leaves it vulnerable to cyber-attacks and/or monitoring, resulting in a loss of personal privacy and data. To guarantee that proper cyber security measures are in place, rules and regulations following data protection laws must be developed.

Awais Ahmed, CEO of Pixel, which raised $5 million in seed funding in August said “India has many advantages in space technology, Indian companies will spend less both in terms of manufacturing and operating costs as compared to US companies, we have an enormous talent pool of engineers that we can tap into, and the VC ecosystem is warming up.” The rising global worry over space debris has even reached the United States. India is embroiled in an international controversy over debris from an Indian satellite that fell on a Japanese hamlet as it retraced its path back to Earth. India has a definite obligation to pay compensation for damage induced by its space object on the surface of the Earth or to aircraft in flight as a party to the 1972 Convention on International Liability for Damage Caused by Space Objects.

Concluding Observations

Indian space science has a lot of potential in establishing a strong connection with India’s Economic growth by adopting effective measures and upcoming policies which are going to change the perspective of the world on India’s Space Laws. Resilience in the space law is all the more important to support the expansion of the Indian space sector and allow private companies to participate in making India a space powerhouse. In line with Articles 51 and 253 of the Indian Constitution, India must enact legislation that would not only enable public-private partnerships and quick technical growth but also accelerate indigenization and manufacturing within the country. Also, the introduction of the India Draft Space Law Policy will widen the scope of development by allowing for the issue of a non-transferable license to individuals involved in commercial space activities. It also specifies appropriate licensing systems, eligibility requirements, and license prices.

Over twelve years, the competition has become one of the biggest moot court competitions in the country which consistently witnesses participation from the top law schools in India with more than 35 top law schools participating in 2021. The competition promises a challenging problem, high competition and excellent judging.

Participants will be provided with the opportunity to argue before an illustrious panel of judges, including judges from Cyril Amarchand Mangaldas and the Competition Commission of India.

Eligibility

Participate in the Competition by registering a team consisting of at least two and not more than three members. A maximum of forty teams will be hosted this time.

The RMLNLU Journal on Communication, Media, Entertainment & Technology Law (hereinafter ‘the Journal’) is an annual, student-edited, peer-reviewed law journal published by the Journal Committee of Dr. Ram Manohar Lohiya National Law University, Lucknow.

Through this Journal, the Committee aims to foster the spirit of writing and set in motion a discourse among knowledgeable intellectuals from various fields of law.

The Journal Committee is pleased to announce the call for papers for The RMLNLU Journal on Communication, Media, Entertainment & Technology Law, Volume IX.

This is a theme-based journal and only accepts submissions pertaining to the same.

Call for Papers

The Journal accepts submissions from law students, academicians and legal professionals all over the country and abroad in the form of:

  • Articles: 5000-7000 words. (These are evaluations of specific contemporary issues and aim at conceptualizing the issues in a unique and unconventional manner. The assessment of contemporary issues shall be appreciated, though not mandatory).
  • Case notes/comments: 2000-3000 words. (These are assessments of the aim and legal impact of contemporary judgments and legislations).
  • Book Reviews: 2000-3000 words. (Entries submitted under this category may present innovative evaluations of present literature).
  • Essays: 4000-5000 words.

The submissions may be on any contemporary legal issue connected with media law and its allied fields of communications, entertainment and technology. The authors are expected to adhere to the prescribed word limit as indicated above.

Note: The prescribed word limits exclude Abstract, whose word limit has been prescribed in the guidelines that follow, and footnotes, wherein speaking footnotes must be avoided wherever possible.

Each of these entries shall be required to conform to the set of guidelines that follow.

All the sources in the footnotes must be properly cited strictly in accordance with the latest OSCOLA (4th edition) format. No endnotes or speaking footnotes (descriptive footnotes) are allowed.

General Instructions

  1. The submission should be original and non-plagiarised. They should exhibit originality in thought, critical evaluation, and careful interpretations. Submission of a paper shall be taken to imply that it is an unpublished work and is not being considered for publication elsewhere.
  2. Co-Authorship to a maximum of two members is allowed. However, co-authorship is not allowed in “book reviews” and “case notes/comments”.
  3. Acknowledgement and Declaration by the author(s) need not be included.
  4. The contents should in no way, directly or indirectly, indicate or reference the identity of the author(s).
  5. The author(s) must send in the cover letter in the body of the mail, which must contain all the relevant biographical details (Name of the author(s), their degrees, Designation, Name of College/University/Institution, Postal Address(es), Phone Number and email ID). A separate attachment as a cover letter will not be entertained.
  6. The authors must attach only one manuscript to the mail which must include the abstract and the main content of the paper. The authors must refrain from adding any other information (such as personal information, declarations) in this manuscript. 
  7.  The file name of the attached manuscript must be the name(s) of the author(s).
  8. The subject title for the mail must be ‘Article/Essay/Case Comment/Book Review for Volume IX’. 

Declarations

  1. Editors’ decisions shall be final and binding. They reserve the sole rights to the publication of the selected articles in addition to, inter alia, any edits/amends/reproduction.
  2. The contributions presented to and accepted for publication and the copyrights therein shall be the intellectual property of the Journal Committee, Dr. RMLNLU.

Please note, that only one submission per author or a team of co-authors is permissible. In case of more than one submission, only the one received first would be considered for review.

There shall be a rigorous review process comprising 3 stages and spanning 45 days. The authors shall be intimated about the status of their manuscript at every stage.

General Guidelines

  • The Comparative Constitutional Law and Administrative Law Journal [“Journal”] attempts to initiate and foster academic dialogue concerning the subject of Administrative Law and Constitutional Law keeping in mind a global perspective. Please note that all submissions must be topical to the scope and theme of the Journal.
  • All submitted manuscripts shall be original. Any form of plagiarism would lead to immediate rejection of the submission.
  • Submission of solicited manuscripts, on invitation from the Journal’s editors, guarantees publication of the same. However, if such solicited manuscript does not meet the Journal’s standards of quality scholarship, final discretion to publish the solicited manuscript vests with the Editorial Board [“Board”]
  • The author(s) must inform the Board if the manuscript has also been submitted to another journal, website or forum. The Board must be notified immediately if an offer for publication from another journal, website or forum is accepted by the author(s).

Author(s)

  • Each manuscript may have up to two authors, however co-authorship is not permitted for Book Reviews and Case Comments
  • In case of joint authorship, the author from whom a submission is received by the Board, shall intimate the Board of the name, credentials and contact details of the intended co-author.

Citations and References

  • All relevant sources shall be duly acknowledged as footnotes.
  • Speaking footnotes are allowed
  • The text and citation styles shall conform to the rules prescribed in The Bluebook: A Uniform System of Citation (20th edition).

Style Guidelines

The Journal accepts submissions in the following categories:

  • Articles- Not exceeding 10,00 (Ten Thousand) words. Articles must deal with issues of interest and relevance and must demonstrate a high level of analysis. Articles of a purely descriptive nature are not preferred.
  • Notes- Not exceeding 4000 (Four Thousand) words. Notes should cover a recent development or should be issue-specific. A Note functions as a more condensed and succinct Article.
  • Case Comment- Not exceeding 3000 (Three Thousand) words. Case comments entail a critical analysis of recent case laws and policy developments.
  • Book Reviews- Not Exceeding 2000 (Two Thousand) words. Book Reviews entail providing critical analysis and review of any book that deals with the subject matter of the Journal.

Note: All manuscripts must necessarily be accompanied by an abstract of not more than 350 words.

Word Count: Please note that the word limit would be considered excluding the footnotes, except when speaking footnotes are used. The journal may accept shorter or longer submissions depending on the quality of the submission.

Formatting Specifications

  • The manuscript must be word-processed in Garamond.
  • The main body text should be in font size 12 and footnotes in size 10.
  • There should be line spacing of 1.5 between paragraphs and headings in the main body and a line space of 1.0 in footnotes.
  • Verbatim quotes must be put in double quotes and italicised with a 0.5” indent.
  • The entire document, including footnotes, must be justified.

Language: The Journal shall follow British English.

Continuing the legacy of this Institution, the Centre for Consumer Rights and Marketing (CCRM) came to be established in the year 2019.

This Centre has been established to advocate and raise awareness about Consumerism, redressal mechanisms and ethical marketing, not only to benefit SLSH but provide opportunities to students of all institutions to increase their awareness. Team CCRM consists of members from first year through the fifth year along with our esteemed faculty in charge Dr. M Rajanikanth.

About The Chair on Consumer Law

The Chair on Consumer Law has been established at the National Law University, Delhi by the Department of Consumer Affairs, Ministry of Consumer Affairs, Food & Public Distribution, Government of India in the year 2019. The Chair was set up to act as a Think Tank for Research and Policy related issues on Consumer Law & Practice, and to develop Consumer Law as a distinct subject of study both at Under Graduate & Post Graduate levels.

About the Essay Competition 2022

The Consumer Chair at National Law University Delhi proposes to organise an Essay Competition as part of celebration of World Consumer Rights Day, 2022 (15th March). The Essay Competition endeavours to stimulate interest and foster growth amongst students to explore and engage with contemporary and seminal issues in the field of consumer law and policy.

To ensure wider reach and opportunity, the Essay Competition will be open to all – including students, academics, professionals, government officials, members of consumer fora, Voluntary Consumer Organisations (VCOs)/ NGOs etc.

  • E-commerce & Consumer Protection
  • New Features of the Consumer Protection Act, 2019
  • Product Safety
  • Data Protection and Consumer Protection
  • Use of ADR/ ODR for Redressal of Consumer disputes
  • Legal Metrology Law & Consumer Protection
  • Food Safety & Standards Law & Consumer Protection

The above themes are only indicative and the participants are free to choose any other topic under the broad theme of consumer protection.

Eligibility

To ensure wider reach and opportunity, the Competition will be open to all – including students,
academics, professionals, government officials, members of consumer fora, Voluntary Consumer
Organizations (VCOs)/ NGOs etc.

Submission Guidelines

  • The essay must be written in English and submitted in Microsoft Word document format (.doc/.docx).
  • Co-authorship up to a maximum of two authors is permitted.
  • Only one submission is allowed per author/team. Submissions, both as co-author and single, will be treated as multiple submissions and will be disqualified as an entry to the competition.
  • The following formatting specifications need to be strictly adhered to: Main Body: Font – Times New Roman, Font Size – 12, and Line Spacing – 1.5; Footnotes: Font – Times New Roman, Font Size – 10, and Line Spacing – 1.0; Margins should be 1 inch or 2.54 cm on all sides.
  • The word limit is 2500-3000 words excluding footnotes. Footnotes must follow the Bluebook system of citation (Harvard, 20th edition).
  • The essay must contain an abstract, not exceeding 250 words (which would not be counted in the word limit for the essay). It must indicate the theme/topic.
  • All submissions should be made in an electronic form at consumerchair@nludelhi.ac.in under the subject heading “Submission: Essay Competition 2022” by February 20, 2022, 23:59 hours.

How to Submit?

  • The essay must be accompanied by a separate document containing the following:
    • (i) full details of the participant viz. name, institution affiliation; phone number, email ID etc ;
    • (ii) theme/topic chosen;
    • (iii) A declaration that: “The Essay is an original work of the author(s).
  • I (We) certify that my(our) submission is original, has not been published elsewhere, and is not under review or consideration elsewhere.”
  • Incomplete or plagiarized submissions shall be summarily rejected. The similarity limit is 15% (excluding footnotes).
  • The final publication of all submissions shall be subject to changes by the Editorial Board.
  • The Board reserves the right to summarily reject or return the submission to the author/authors without feedback for non-compliance with these guidelines. In case of any dispute, the decision of the Board shall be final and binding.
  • The opinion/thoughts/ideas or any view of the author expressed and published on the essay are respective views of the authors. The Chair or the Board shall not be held responsible or accountable for the opinion expressed by the author on the essay.
  • The Chair reserves the right to cancel the competition without notice, in case suitable/quality entries are not received in the competition or in case of any other event outside our reasonable control.

  • Runner up: ₹ 2500 & Certificate of Merit
  • Second Runner-up: Certificate of Merit

The best entries will also be published in the next issues of the Newsletter of the Chair on Consumer Law.
