ABOUT

In the central part of India, the State of Chhattisgarh is richly blessed with forest and mines in around 135 sq. km of land. It has the 3rd largest forest area in India. Chhattisgarh is covered by deciduous and dry deciduous vegetation.
Deciduous forests cover roughly 44% of the State. The forests and woodlands are home to many animals and species of birds like Gaur, Sambar, Blackbucks, Pahari Myna, etc. Teak, Sal, Salai, tendu, and Bamboo trees are mainly found in
the State.

The Mitakshara philosophy, which is prevalent in most regions of India, believes that a male’s ability to be a coparcener is innate. However, if a baby boy is the fourth longitudinal descendant, i.e., a great-great-grandson, and his human ancestors are still living, the privilege to be included in the coparcenary will not be available until becomes the third descendant.

In Chokhelal & Ors. vs Ashwini Kumar & Ors the respondent had initially filed a suit for the pronouncement of 1/12 partition with another decree of separate possession for the house which was in contention. It was further claimed by the respondent that the property was his ancestral property which had belonged to the common ancestors wherein the great grandfather of the appellants was included.

The respondent further claims that after the death of the great grandfather, his son, following which his brother and thereafter the defendant became the Karta of the family. The name of the respondent was then recorded in the suit property. The appellant in his contention had mentioned that the property was not a Hindu joint family property and hence the contention by the respondent is not valid. The appellant further said that the house was built by his father. His father mentioned that the respondent was allowed to live in the house along with his family as a licensee.

The decision of the learned trial court stated that the suit was dismissed on the basis that the property in contention is not a joint Hindu family property and the appellant in this case i.e., Mr. Kumar was the exclusive owner of the property as the plaintiffs had separated themselves from him. The appellant had the rightful duty to sell off the property if he wanted to. The respondents filed an appeal aggrieved by the decision of the trial court.

The appellants had filed a counterclaim which had been dismissed by the trial court and then by the first appellate court. The second appeal of counterclaim had been filed before the High Court of Madhya Pradesh.

The Hon’ble High Court in its observation of the appeal filed by the respondents had stated that the respondent had been born prior to the Hindu succession act and had a right to the joint Hindu property belonging to his great grandfather. Furthermore, the court stated that the property being the joint Hindu family property was never under the ownership of the appellant or his father.

The court further stated in this case that the dismissal of the appeal of the counterclaim filed by the appellant is correct by the lower appellate court. The final order passed by the first appellate court was confirmed and the second appeal was dismissed.

The Union government’s “Agnipath” scheme is being contested, and the Supreme Court announced on Monday that it would hear arguments next week. According to the news agency PTI, a statement has been made by a bench comprising Justices Indira Banerjee and JK Maheshwari that, When the Supreme Court reopens after its summer break, cases challenging the recruiting plan would be listed before the relevant bench.

Notably, on June 21, the Union government submitted a caveat motion to the Supreme Court pleading with it to hear the government in the petitions brought before it contesting the “Agnipath” defense force recruitment plan. A petitioner filed a caveat application to ensure that no unfavorable judgment is rendered against them without a hearing. According to advocate ML Sharma, the Agneepath scheme is “illegal and unconstitutional,” so he filed a PIL to
have the Centre’s notification of it quashed. Sharma claims in the PIL that the government invalidated the 100-year-old mechanism for choosing the armed forces, which led to the violation of the constitution.

The Agnipath program, unveiled on June 14, calls for recruiting young people between the ages of 17 and 21 for only four years, with the option to keep 25% of them for an additional 15 years. Protests against the idea have already begun in a number of states. Later, the government increased the hiring age limit from 18 to 23 beginning in 2022.
The appeal also mentions nationwide demonstrations against the plan. It has asked for permission to form an expert committee with a former high court judge as its head to investigate the scheme and its effects on the Army and national security. Attorney Kumud Lata Das brought up a petition submitted by potential air force members for urgent mentioning before a vacation bench comprising Justices Indira Banerjee and JK Maheshwar. The attorney argued that the method shouldn’t be applied to people who are currently going through the selection process.

According to her submission, the Agnipath system will reduce the applicants’ term from 20 years to 4 years. The counsel continued,

“The 31 selected candidates who are awaiting their enlistment as Airmen in the IAF in Group X Trades and Group Y for Intake 02/21 conducted by the Central Airmen Selection Board (CASB) preferred the petition under Article 32 in response to the advertisement dated 11.12.2019 for which online applications were requested from 08.01.2020 to 12.01.2020 for both Group X and Group Y streams. Despite numerous mentions, the Registry has not provided a specific date of listing.”

The petitioners were shortlisted and the provisional list was announced on May 31, 2021. However, for administrative reasons, there was no recruitment. The petitioners claimed that on June 14, the Central Government notified the Agnipath plan without concluding the enrolment procedure for 02/2021. They contend that they are not at fault for the recruiting process’s delay and that the authorities cannot stop their hiring now.

It can take up to 500 years for plastic bags to disintegrate, so they make up a large portion of what stays in our landfills and pollutes our waterways. International Plastic Bag Free Day looks for safer alternatives to demonstrate that a world without the use of so much plastic is possible. It is part of the Break Free from Plastic Movement, which began in September 2016, and has been joined by nearly 1,500 different organizations. The movement is looking for solutions to

The Vidhi Centre for Legal Policy (Vidhi) invites applications for the post of one Research Fellow for its Legal Design and Regulation vertical at the New Delhi Office.

ABOUT

Vidhi is an independent think-tank doing legal research to make better laws and improve governance for the public good. Vidhi is committed to producing legal research of the highest standard with the aim of informing public debate and contributing to improved governance. Vidhi works with Ministries of the Government of India and State Governments, as well as other public institutions, providing research and drafting support at various stages of law-making. Vidhi also conducts and freely disseminates independent research in areas of legal reform which it believes is critical to India’s future.

ROLE DESCRIPTION

Vidhi is looking for one Research Fellow for its Legal Design and Regulation vertical. You can access a brief description of this vertical, and the work that it does here. 

The Research Fellow will be expected to:

1. Undertake high-quality research on a wide range of issues pertaining to regulatory reform, administrative law, and constitutional law as well as its intersections with public health, technology, gender, media, agriculture, labor, and employment. 

2. Coordinate closely and attend meetings with government officials, academics, researchers, and other stakeholders.

3. Engage with government officials on ongoing and new projects in conceptualizing reports and drafting legislation.

4. Be organized, detail-oriented, and able to meet short deadlines.

5. Prepare reports, research notes, and presentations.

6. Organize and attend consultations with key stakeholders for informing and disseminating Vidhi’s research.

7. Write articles, and blogs and participate in podcasts to disseminate research work.

LOCATION

● This is a full-time position based out of New Delhi.

● The Research Fellow will be engaged in this position for a duration of one year, and renewal shall be subject to performance.

● Remuneration will be commensurate to the level of skill and experience.
