The Jindal Global Law School’s Center for Justice, Law, and Society (CJLS) is an interdisciplinary research centre that critically examines current issues at the nexus of law, justice, society, and marginalisation in South Asia. A group of academics, activists, and students working together on the CJLS project are conducting high-quality empirical and theoretical research. In order to address the shifting dynamics between law and society in South Asia today, CJLS puts the issue of justice, particularly intersectional justice, front and centre in the field of law and society studies. Judicial diversity, critical pedagogy, critical legal theory, gender, sexuality, constitutional law, public health law, caste and indigeneity, and social movements and the law are some of the topics that CJLS focuses on.

On Friday, the Supreme Court rejected Zakia Jafri’s appeal, which questioned the clean chit of Special Investigation Team’s (SIT) given to the then-Chief Minister, Narendra Modi and numerous other individuals in the 2002 Gujarat riots. Zakia Jafri is the widow of former Congress MP Ehsan Jafri. However, it was held that the appeal is without substance, according to a bench led by Justices AM Khanwilkar.

BACKGROUND
Zakia’s husband, Congress MP Ehsan Jafri, was brutally murdered in the Gulberg Society massacre during the Gujarat riots in 2002. According to her when Mr Modi was Gujarat’s chief minister at the time, he was charged with not doing enough to put an end to the anti- Muslim riotsā€”a charge he has consistently refuted. Zakia was forced to go to the Gujarat High Court to request that the complaint be regarded as a FIR because the State police did
nothing. However, the petition was dismissed by high court.

This was challenged before the supreme court and subsequently an impartial Special Investigation Team (SIT) was appointed by the Supreme Court in 2008 to check this matter. No evidence was discovered against Mr.
Modi in the riots case, according to the report that investigators provided in 2012. Zakia Jafri’s challenged SIT’s clean chit given to 64 people including Narendra Modi before the supreme court.


PETITIONERā€™s CONTENTION

It was argued that the SIT did not thoroughly investigate all the pieces of evidence that pointed to a bigger conspiracy. Senior counsel Kapil Sibal led the arguments for Zakia Jafri against the Gujarat High Court’s ruling for a number of days.
RESPONDENTā€™s CONTENTION
The SIT had contested Jafri’s argument, claiming that the complaint was part of a diabolical scheme to look into the “bigger conspiracy” that led to the riots in Gujarat in 2002 and that Teesta Setalvad, a social activist, had allegedly directed Jafri’s initial complaint in an effort to stir up trouble.

SUPREME COURT DECISION
Supreme stated that in relation to the events that occurred in Gulberg Society on February 28, 2002, including the attack on Ehsan Jafri, a FIR was filed on June 8, 2006. Therefore, the SIT’s task with regard to Zakia’s complaint was to investigate the claims that were not already the subject of an investigation in connection with the four crimes involving the Gulberg Society case. SIT’s reach was therefore restricted to the allegation of larger criminal conspiracy at the highest level resulting in mass violence across the State during the relevant period.


The court further observed that the allegation of larger conspiracy was based on the ‘sensational revelationā€, which were later established to be false by the SIT. According to Mr. Sibal’s argument, the dead bodies were paraded to Ahmedabad after the post mortem was conducted in an open yard at the railway station. The court held that full procedure was followed by state administration regarding the dead bodies and the contention was dismissed.


The Bench determined that the appellant’s claim that only one community was being targeted also lacked evidence. Therefore, the court held that Conspiracy cannot be readily inferred merely on the basis of the inaction or failure of the State administration.

RELATED PROVISIONS
ARTICLE 356 OF INDIAN CONSTITUTION ;Article 356 deals with breakdown of constitutional machinery. The court in this case observed that misgovernance or failure to maintain law and order for a brief period of time shall not come under article 356.
SECTION 120B OF INDIAN PENAL CODE; This section deals with criminal conspiracy and with regard to this case the court observed that in order to prove a larger conspiracy, prior meeting of minds must be proved in the court of law.

The Bombay High Court Nagpur Bench in the case of Vijay Darda & Anr. v. Ravindra Gupta ruled that the media has their right to report on the registration of FIRs, arrest of persons, and filing of cases in the courts and quashed the FIR filed against Lokmat Media.

Lokmat Media is a daily newspaper publishing company in the State of Maharashtra. Mr. Vijay Darda (Applicant No. 1) is the Chairman of the Lokmat Media Pvt. Ltd. And Mr. Rajendra Darda (Applicant No. 2) is an Editor in Chief of the Lokmat Media Pvt. Ltd.

On 25th May 2016, Lokmat Media in their newspaper published a news item stating the FIR that had been then recently registered against Mr. Ravindra Gupta along with the officials. Mr. Ravindra Gupta felt the published news item was against him and filed a private complaint against Lokmat Media.

Complainantā€™s Contention

The complainant contended that the news/information published by the respondentā€™s firm i.e., Lokmat Media in their newspaper is allegedly published to defame the complainant. Mr. Ravindra Gupta felt aggrieved by the news information which was published and filed a private complaint against the Chairman and the Editor in Chief, of Lokmat Media i.e., Mr. Vijay Darda, and Mr. Rajendra Darda respectively. He stated that the information that Lokmat media had published was false, frivolous, and intending to defame him, damaging his reputation in society.

The complaint filed by, Ashok Gupta, who was also one of the accused in the FIR, was later produced to be untrue. He was not present at the time of the occurrence of the crime and was dismissed from the charge. The complainant had filed a private complaint before the court of judicial magistrates, first class. The complainants then proceeded to the court referring to the case of Prabhu Chawla v. the State of Rajasthan and Anr. (2016) 16 SCC 30 regarding section 482 of the Code of Criminal Procedure.
The complainant filed the complaint alleging that the applicants have committed an offense under sections 499 and 500 of the Indian Penal Code, which provides the punishment for defamation and stated that the applicants should have investigated the matter thoroughly and made sure that the facts and information that were to be published were true and genuine.

Respondentā€™s Contention

Considering the accusations made by the complainant, the respondent contends that firstly, the information published by the Lokmat Media was only the information that a police report was filed, and an FIR was registered against Mr. Ravindra Gupta. There was no such news item published that could harm the reputation of the complainant and was not in accord with the police report.

The counsel of the applicants presented that under section 7 of The Press and Registration of Books Act,1867, the applicants are the chairman and editor-in-chief, not the editor of the newspaper. Considering this, the applicants are not responsible for the contents of the newspaper just because of the ownership. They do not know about every article and information published in their newspaper.

According to the Act, the person who is responsible for the content is the Editor as described in Section 1 of the act, which says ā€œEditorā€ is the person who determines which content is to be published in the newspaper. The name of the editor is mentioned below the article in every newspaper. The editor of Lokmat Media is Dilip Tikhile and the person responsible for the content of the newspaper. The counsel also referred to the supreme court case K.M. Matthew v. the State of Kerela and Anr. (1992) 1 SCC 217. That the person who should be responsible is the editor only and not every person who is connected to the newspaper. On the acts of the employees, the owners and chairman cannot be held responsible for vicarious liability as referred to in the above case.


The counsel of the applicants also held that as the FIR is registered, it is published on the official website which is in the public domain, and the public has every right to know about the cases and registered FIRs. There was no such information that was not published. Relying on the supreme court case of Youth Bar Association v. Union of India and Anr. (2016) 9 SCC 473, the registration of crime is not a private affair anymore. This presented that the applicants did not commit any crime under sections 499 and 500 of the Indian Penal Code.

Bombay High Court Judgement

The bench considered all the points made by the complainant and the respondent and held that the person responsible for the content in the newspaper is the Editor and not the people who are connected or merely connected with the newspaper company.
The Nagpur Bench of Bombay High Court on 20th June 2022 ruled that the media reporters have a right to report news information on the registered FIRs, arrests of persons, and cases filed as the information is in the public domain. It is the job of the media to let people know what is happening around the world. The order dated 16th January 2018 against the applicants is quashed and set aside. The criminal complaint against the applicants stands dismissed and disposed of.

ABOUT

These full-time positions are intended to serve as a bridge between either undergraduate study or work in the legal profession and a tenure-track academic position with a strong foundation in Singapore law.

Successful candidates will be appointed for two years on a competitive salary. You will teach half of the standard faculty workload, typically by joining one of the team-taught compulsory subjects. The reduced load will free up considerable time for research, supported by a faculty mentor who will read and comment on your work, and advise on publication avenues. Sheridan Fellows are expected to actively participate in faculty events and to present at least one paper in the Faculty Research Workshop.

ELIGIBILITY

  1. An outstanding undergraduate LLB degree.
  2. Demonstrated potential to produce high quality research.
  3. Applicants may also have an LLM degree (or its equivalent) but this is not essential.

REDRESS is seeking Legal Fellowship applications from excellent graduates, postgraduates and individuals in the early stages of their careers with a strong background in international human rights law to contribute to REDRESSā€™s work in either London or The Hague.

ABOUT

Legal Fellows at REDRESS are exposed to all aspects of working at a human rights organisation. The work typically includes:

  • Undertaking legal and policy research at the national, regional and international level;
  • Developing policy positions and drafting legal and policy reports;
  • Networking and attending meetings with high-level stakeholders;
  • Developing advocacy strategies and drafting advocacy briefings;
  • Drafting submissions before regional or international courts and UN mechanisms;
  • Organising events;
  • Assisting with fundraising and communications work; and
  • Administrative tasks as required.

In addition, fellows sometimes have the opportunity to be involved in casework, but this cannot be guaranteed. As REDRESS is a relatively small organisation, fellows take an active role in all aspects of our work and have the opportunity to get fully involved in our projects,  supported by REDRESS staff. Fellows are treated as valued members of the team and make a meaningful contribution to REDRESSā€™ work.

ELIGIBILITY

The following are essential:

  • A qualification in law (this can be an LL.B, LL.M or J.D).
  • An LL.M or strong background in human rights
  • Strong research
  • Fluency in

The following are desirable:

Fellowships are full-time and typically last a maximum of one year and a minimum of four months.
