Campus Law Centre, Faculty of Law, University of Delhi, Delhi will be hosting the “19th K.K. Luthra Memorial Moot Court, 2023” to be held in the 3rd weekend of January 2023 i.e. from 13th to 15th January 2023. The K.K. Luthra Memorial Moot Court is the only Moot Court held exclusively on Criminal Law in India. The last two editions i.e. 17th and 18th editions were held virtually due to the sudden resurgence in COVID-19 cases at the global level.
This International Moot Court is held in the memory of late Mr. K.K. Luthra, Senior Advocate, a renowned criminal lawyer from India.
The Inaugural Function, Draw of Lots and Preliminary Rounds-I will be held on 13th of January, 2023 at the Campus Law Centre, University of Delhi, Delhi. The Preliminary Rounds-II, Octa-Final (at the discretion of the organizers) and Quarter-Final Rounds will be held on 14th of January, 2023 at the Campus Law Centre, University of Delhi, Delhi.
The Semi-Final and Final Rounds will be held on 15th of January, 2023 followed by the Prize Distribution at The India Habitat Centre, Lodhi Road, New Delhi.

ELIGIBILITY:
· The submission is open to all Law Students registered in Graduate/Post Graduate Course in any Institution/ College/ University.
· The students can register themselves as a team of 2 or may also seek single registration.
· There is no restriction on the number of entries from any college or university.
· The participants shall write a single opinion. Multiple opinions/dissenting opinions are not allowed.
FORMAT GUIDELINE:
· Language- The language for writing the judgment shall be in English only.
· Word limit – Maximum of 5000 words (including foot notes).
· Main Text – Times New Roman, font size 12, double spacing, justified, with a margin of an inch on all sides.
· Footnotes – Times New Roman, font size 10. Substantive footnotes are accepted.
· Citation Mode – Any uniform method of citation is allowed.
· Page numbers must be at the bottom center.
SUBMISSION PROCEDURE:
· A cover page stating the name of the competition, the name of participant’s institution and the names of student author, with the signature of student author.
· Only single author is permitted.
· The Judgment Writing shall begin on the next page. The first page of Judgment must contain Team Code, Name of the Court, Title, Number of the Case, Date of Delivery of Judgment, Nature of the Case (Civil/Criminal/Writ).
· Do not state any matter in the judgment (except the cover page) that might reveal your identity or of your institution.
· All the Judgments must be saved and sent as PDF file. The title of the file must be in the following format CPUH_JWC_ TEAM CODE.
· The participants who register for the event shall be provided with a Unique Registration Code which shall be used for all further communication and submission of the write-up.
· The write-ups shall have no plagiarism and should be the original work of the participants.
· The write-up must be submitted in both Microsoft Word and PDF format.
· The write-up must be sending on Google form link. (The link will be shared on 19 April 2022 by E-Mail)

The most controversial election in the history of America is the one occurred in 1800, where the anti- federalists run by democratic republican and vice-president, Thomas Jefferson took the office. Due to the fright of losing the influence, the federalist led congress passed the midnight judges act which was earlier called as “judiciary act of 1801”. Under this act, they re- organised the federal judiciary and the District of Columbia organic act by appointing new justiceship and judgeship. The head of federalist, john Adams appointed several federalists as judges and they are thus called as “midnight judges or midnight justices of peace” and were approved by congress. As a final step the commissions are supposed to be physically delivered to the appointees by the secretary of state and that was john Marshall.
ISSUE
John Marshall, the chief justice, was unable to deliver the commissions before the Jefferson sworn in the next day. The undelivered commissions were still in the office even after Madison took in charge as the secretary of the nation. And he was instructed by Jefferson not to approve the new commissions. One among them who never got the commission was William marbury. Congress sanctioned US Supreme Court to issue the writ of mandamus under judiciary act, 1789 where a case was filed against Madison by marbury in United States Supreme Court under its original jurisdiction to bring Madison deliver the commission.
JUDGEMENT
At the initial stage, the chief justice, marshal stated that: “marbury had been lawfully appointed and confirmed as the justice of peace and therefore had a right to his commission”. But unfortunately, court denied to issue the writ by stating that the section of the judiciary act, 1789 is unconstitutional. The section was at odds with the article III of constitution which specifically lays out the original jurisdiction, though it empowers congress to pass laws related to court’s appellate jurisdiction.
RATIO DECIDENDI
In this landmark case, Supreme Court stated the act to be unconstitutional as it tends to expand the Supreme Court’s original jurisdiction beyond the limit referred in constitution.
It was through this case the idea of “judicial review” got established.
CONCLUSION
The case was stated as a landmark case in the history which led to the emergence of concept ‘Judicial review”.

Eligibility
Applications are invited from practitioners, academicians, journalist, students of any discipline, or anyone who wishes to express an opinion can submit their articles.
Submission Guidelines
Submissions shall be typewritten in MS Word, Times New Roman font size 12 with line spacing 1.5 and justified alignment.
Co-authorship up to two authors is allowed.
Submissions shall not be less than 700 words and shall not exceed 1000 (exclusive of endnotes).
Submissions shall contain hyperlinks in the body of the manuscript itself, instead of footnotes and endnotes. Endnotes may be used for references where hyperlinks are not possible, or the source is under a paywall or offline – such as books, articles, etc.
The authors should conform to the Bluebook (20th edition) Uniform System of Citation. Endnotes shall be typewritten in, Times New Roman, font size 10, single-line spacing, and justified alignment.
The manuscript should not contain any identification of the author/s, which shall be a ground for rejection of the submission.
The submission must be the original work of the authors. Plagiarism beyond 10% shall not be accepted.
Manuscripts shall be assessed by subjection to Blind Review Procedure.
Submissions shall be lucid, contemporarily relevant, and well-researched. They shall contain a novel analysis of the issue by the author(s).
Authors will be informed regarding acceptance or rejection of their manuscripts within 10 to 15 days and an acknowledgement receipt will be sent within 48 hours of submission of the manuscript.
