The Apex Court recently issued notice in reference to a plea made by Twitter India who was seeking the quashing of numerous FIRs registered against it for the promoting of a tweet by one Gurpatwant Singh Pannum on “Khalistan“, allegedly.

Twitter claimed that multiple FIRs have been registered against the corporation after Gurpatwant Singh Pannum had tweeted a poll on Twitter on “whether India should recognize Khalistan’2020.”

The plea put forward by Twitter stated that Vinit Goenka, National Co-Convener of the BJP IT cell and several other complainants claimed that Twitter had taken monetary consideration to promote the “Khalistan” tweet, whereas in reality, Twitter had blocked the questionable tweet and furthermore, suspended his account.

Twitter India submitted that in the past several months, Vinit Goenka and his supporters have conducted webinars demanding for Twitter to be announced as a terrorist organisation, for Twitter’s officers to be charged with sedition and moreover, to instigate mass filing of cases against Twitter and its employees.

The claims alleged by Vinit Goenka and his supporters are frivolous, unfounded and actuated by malice, Twitter added, arguing that it had no role in deciding Twitter’s Ad policy and that Twitter does not obtain revenue for the content that is promoted on their platform.

Twitter Communications stated that it has no control whatsoever over the content shared on the website and that the content is monitored by Twitter Inc, which is based in the United States. Twitter also stated that their role is limited to promoting brands, research, development, marketing and soliciting.

Twitter has therefore pleaded for the consolidation of themultiple FIRs filed against them in one place, pointing out the example of Arnab Goswami, in whose case the Supreme Court, under Article 32 of the Constitution had directed the consolidation of such FIRs when there were multiple in number.

Twitter Communications had also claimed that Vinit Goenka had called upon users to file multiple cases against the Twitter with the sole intention of harassing, threatening and intimidating the entity.

Restating that multitude of cases cannot be filed for the same act, the Indian entity stated that all the complaints, filed across eight States in India, are identical in nature and allegations.

Twitter’s plea added that the doctrine of vicarious liability can be implored only in certain exceptional cases.

Twitter Communications had also moved the Gauhati High Court to quash the lead FIR registered in Tinsukia, Assam. Thus, Twitter’s plea stated that they do not pray for quashing of the Assam FIR due to its already being pending before the Gauhati High Court, but seeks quashing of the rest of the identical FIRs.

Twitter has urged the court to combine all the FIRs into one at Tinsukia, in the alternative.

Advocate Sajjan Poovayya appeared as the legal counsel for Twitter assisted by Avocates Manu Kulkarni, Parul Shukla and Saransh Jain. The notice in this matter was issued by a Bench which was headed by the Hon’ble Chief Justice of India, SA Bobde.

In the proceedings which were conducted via video-conferencing, the bench, also comprising Justices A S Bopanna and V Ramasubramanian, issued notices on the plea to the Union Ministry of Home Affairs and Karnataka, Assam, Haryana, Andhra Pradesh, Arunachal Pradesh, Maharashtra , Odisha and the Police Commissioner of Delhi.

The bench has also requested responses from the numerous complainants who have filed the complaints against Twitter, a social media giant.

The bench has also issued the notice to Vinit Goenka, a BJP functionary who claimed that the firm had allegedly taken monetary consideration to promote the questionable tweet.  

Twitter had argued that they have no control whatsoever over the shared content on Twitter’s website and that the content is monitored by the Twitter Inc based in USA.

SUBMISSION GUIDELINES:

• The Corporate Law Board accepts submissions on a rolling basis on corporate law, securities law, insolvency law, banking law, commercial, competition law and taxation law etc.
• Submissions can be in the form of articles, opinions, case comments and short notes on the aforementioned topics.
• Submissions for the blog shall be reviewed on a rolling basis.
• Submissions must be original. By submitting an article, the author undertakes that it has not been submitted, accepted, or published elsewhere.
• Authors are advised to keep their articles concise and precise to enhance the effectiveness of their posts, ideally not more than 1500 words excluding footnotes.
• Authors are advised to make succinct, initial paragraphs to summarize the substance of their posts.
• The font size should be Times New Roman 12 for the body, TNR 14 for headings with 1.5 line spacing for the text in the body. The footnotes should be TNR 10 with single spacing.
• All relevant sources must be given proper referencing. The mode of citation to be followed is OSCOLA.
• Submissions must be in Word Format (.doc or .docx).
• The maximum number of co-authors permitted is two.
• Please ensure that the title of the submission is not more than eight words long.
• Authors must include their full name and institution/organization name in the separate cover letter and submit their Blog at (ailf12345corporate@gmail.com) with the subject line- ‘AILF Corporate law Blog Submission’.
• The Corporate Law Board solely reserves the right to accept or reject the submission after a due and rigorous editorial review.
• Any non-compliance with the above-mentioned guidelines shall result in a breach. Thus, leading to the rejection of the submission.
• The author will be communicated about the acceptance or the rejection of his/her submission within 2-3 weeks of submitting the blog via email.
• Non-adherence to the above-mentioned guidelines will lead to a direct rejection of the article.
• If submission of author is accepted, then it will be notified via email once we have uploaded it to our Blog website and certificate of publication will be issued to the author.
  

ENTRY FEE:

No entry fee will be charged. Submissions are free of cost on rolling basis. One person can submit as many articles as one wish and as frequently as one wishes to.

Team Attorneylex is a newly developed organisation that is devoted to the law students of the country. Our primary purpose is to guide the law students in their legal research, content writing, analyse the case, read or understand the courts’ judgments, etc. because we believe that these things
are an essential part of the legal profession.

About the National Online Quiz Competition:

Team Attorneylex is organising its 5th Online National Quiz Competition on IPC, CPC & CrPC scheduled to be held on 25, 26 & 27 December 2020.

Eligibility:

Team Attorneylex looks forward to participation from law aspirants, students pursuing 5-year law and 3-years law, and LLM courses. Professionals from the legal fraternity are also invited to participate in
the Quiz.

Important Dates & Timing:

Last date for registration: 23th December 2020, 11:59 PM

CPC: 26th December 2020, 06:00 PM

Details:

IPC Quiz Details( 25th December 2020, 06:00 PM):

● The quiz competition is not a team-based competition, and thus, each student shall participate individually.
● The Quiz will consist of IPC questions, including significant/landmark judgments.
● It will consist of 30 MCQs.
● The total time limit for the Quiz is 10 minutes.
● Every question carries one mark, and there will be no negative marking.

CPC Quiz Details( 26th December 2020, 06:00 PM):

● The quiz competition is not a team-based competition, and thus, each student shall participate individually.
● The Quiz will consist of CPC questions, including significant/landmark judgments.
● It will consist of 30 MCQs.
● The total time limit for the Quiz is 10 minutes.
● Every question carries one mark, and there will be no negative marking.

CrPC Quiz Details(27th December 2020, 06:00 PM):

● The quiz competition is not a team-based competition, and thus, each student shall participate
individually.
● The Quiz will consist of Crpc questions, including significant/landmark judgments.
● It will consist of 30 MCQs.
● The total time limit for the Quiz is 10 minutes.
● Every question carries one mark, and there will be no negative marking.

● The Quiz results will be declared on the social media platforms and the Website of the Team Attorneylex.
● In the case of a tie, Time will be considered (Person who submits early will be given preference).
● Team Attorneylex will not be responsible for any technical error, any connectivity/device failure during the Quiz.
● The results declared would be final and the authority vests with Team Attorneylex to change or modify the same.
