National Law University Delhi (NLU Delhi) and Herbert Smith Freehills (HSF) are pleased to announce the NLU Delhi-HSF International Negotiation Competition (INC) to be held on 09-11 September 2022.

ABOUT

The competition aims at providing an opportunity for law students of top universities across the globe to practice and improve their negotiation skills. It provides a platform for students to compete in a truly diverse and international environment. The competition is carefully structured to simulate legal negotiations, making it particularly useful for those students who aspire to be international lawyers. Students participating in the competition will assume the roles of international lawyers in negotiating a series of legal problems. The problems will be based on real-life examples and will comprise a common set of facts known to all participants and confidential information known only to the participants representing a particular side.

ELIGIBILITY

All students who are enrolled in a full-time law degree (undergraduate or post-graduate) as on 1 September 2022 will be eligible to participate.

SCHEDULE

1. Release of the problems/negotiation simulations: 15 June 2022
2. Deadline for seeking clarifications: 15 July 2022
3. Submission of the negotiation plan: 1 August 2022
4. Registration and welcome address: 9 September 2022
5. Preliminary and advanced rounds: 9-11 September 2022

PRIZES

All participants will receive certificates of participation. The winners will receive a trophy to be held in their university and each member of the winning team will receive a cash prize. The runners-up will also receive a trophy and cash prize. There will be an award for the best negotiator and the best negotiation plan. A spirit of the competition award will also be given to the team that best displays the qualities of good negotiation.

The Office of State Information Commissioner, MP, is currently accepting applications for an internship opportunity during the months of August and September for students majoring in law or humanities.

The interns would be expected to conduct research to support the adjudicatory process, communicate with appellants and officers, prepare case briefs, and support the process of live and online hearings of his Court. On Thursday, the Karnataka High court dismissed the writ petition of Habeus Corpus filed by a transgender, after the girl denied being in a relationship with him. This plea was filed to produce the girl in front of the court.

The petitioner who identifies himself as a man claimed that the girl is in a consensual relationship with him since 2019. The petitioner is of 23 years and the girl is of 18 years. The girl’s parents did not approve of their relationship and tortured her for being in a relationship with the petitioner.

He further alleges that the girl decided to leave her house and came to live with the petitioner. The very next day, the police informed the petitioner that the girl’s parents have filed a complaint of kidnapping their daughter. The police then asked the petitioner to bring her to the police station. The girl’s parents then took her away from the petitioner and they both were forcefully separated by her parents.

The petitioner was not aware of the whereabouts of the girl. He contended that the separation was illegal and unlawful confinement of the girl is a violation of Article 21. Therefore, the petitioner has filed the writ petition.

The police were ordered to produce the girl along with her parents in front of the court where she stated that the petitioner is only her friend. She does not want to live with the petitioner and denied the allegation that she is in a
relationship with the petitioner. She also stated that she wants to live with her parents.

The court stated that the petition filed by the petitioner is not maintainable and it was dismissed by giving a warning to the petitioner to not repeat such acts which violate the rights of a person under Article 21.

Sony Studios filed a federal lawsuit against a number of individuals in this matter, chiefly seeking a permanent injunction against reproducing, making accessible, publishing, streaming, etc, sports events of India’s games. Even during the course of litigation, Sony Studios sought an interlocutory order and sought comparable remedies. The Judge issued Sony Studios an order prohibiting webpages, encompassing redirection, clones, and alpha-numeric variants. A restraining order also was issued targeting rogue websites that replicate, transmit, give access, transmit to the community, or redistribute sports events.

The Tribunal also issued an order directing ISPs to prohibit the aforementioned and other pirate networks, as well as directing the Government of India to issue suitable orders to minimize violation of Sony Pictures’ copyrights during the events.

The preliminary injunction also applied to MSOs and broadband providers, and regional inspectors were established to oversee and enforce the Court’s instructions. The Judge’s rulings principally encompass Sony Pictures’ copyrights, and so by inference allow only reasonable usage of the material related to the cricket matches involving India and England/Sri Lanka.

In this instance, the appellant submitted an application with the chief metropolitan magistrate for the lodging of charges against the defendant for violations of Sections 51, 63, and 64 of the Copyright Act, as well as Section 420 of the Indian Penal Code. Considering the petition, instructions were given to the competent officer to record the FIR in accordance with the applicable legal regulations. Following that, the defendant filed a writ petition with the Delhi High Court, requesting that the court proceedings be quashed, primarily on the grounds that the infraction under Section 63 of the Copyright Act would not be cognizable or bailable crime. The High Court allowed the writ petition and ordered the costs to be recorded against the plaintiffs.

Afterward, the appellant decided to contend this in front of the apex court and stated that the High Court had committed a huge mistake by observing that the offence punishable under section 63 of the Copyright Act is a non-cognizable offense and it is not part of the first schedule of the Cr.P.C. The respondent however contended that the decision of the High Court was correct and the offence under section 63 of the Copyright Act is indeed considered a non-cognizable offence.

The main issue that was raised here was whether section 63 of the Copyright Act and the offence committed by violating it is a cognizable offence or a non-cognizable offence. At the same time reference was made to the High court’s decision on whether section 63 of the Copyright Act can be considered a part of the first schedule of the Cr.P.C. The apex court in its judgment had explained section 63 of the Copyright Act and it provides for the punishment that is awarded to any person who had violated the said section.

In its final judgment, the Supreme Court held that section 63 of the Copyright Act is indeed a cognizable and non-bailable offence and therefore the judgment and the order passed by the High Court are contrary to the views of the Supreme Court. The order was set aside and the Supreme Court ordered the criminal proceedings to start against the respondents in this case for the violation of section 63 and section 64 of the Copyright Act in accordance with the law by treating them as cognizable and non-bailable offences.
